The campaign to Send Karl Rove to Jail just took a huge step forward! In a stunning action just minutes ago, the House Judiciary Committee voted to hold Rove in contempt.

28. No, not really.
Contempt of Congress has no teeth unless the DOJ will bring it to a grand jury, which AG Mukasey has already refused to do for Harriet Myers and Josh Bolton and I'm sure will also do for Rove. If somehow Mukasey were persuaded to refer them then the grand jury would decide whether to bring an indictment. Absent those steps then all that's left is the stigma of it and I'm sure Karl Rove couldn't give a care about that by now.

Congress could instead use inherent contempt, which would allow them to send their own enforcement officers (Sergeant of Arms?) to arrest and hold them.

29. Sad but true. Inherent contempt would result in
jailtime in the Senate basement. "Contempt" means nothing. He is free to do as he pleases. And the Judicial Committee knows it.

Congress has a review of their powers of contempt in Congress’s Contempt Power: A Sketch (http://www.fas.org/sgp/crs/misc/RL34114.pdf) but that paper does notcome to any strong conclusion. It is, however a really good synopsis of the history and issues raised by the Harriet Miers and Joshua Bolton failures to appear.

I am no attorney but scanning this paper, it looks as though Congress allowed the Reagan administration to gut Congressional powers and has not done anything to restore them since - allowing the Bush criminals to insist on their presidential immunity. Congress needs to take back their powers or we are all screwn.

..... outside the House Chambers? I can't find any statutory arrest authority at all, only House "rules."

It seems to me that if the SaA goes outside the Capitol and tries to arrest Rove, he could be stopped by police and charged with assault, false arrest, or kidnapping.

Can any DUer cite the House's authority under inherent contempt outside their building? I'd like to see it. It would make a much stronger case.

It's in that document I linked to in my post above:
"Congress’s inherent contempt power is not specifically granted by the
Constitution, but is considered necessary to investigate and legislate effectively. The
validity of the inherent contempt power was upheld in the early Supreme Court
decision in Anderson v. Dunn and reiterated in McGrain v. Daugherty. Under the
inherent contempt power the individual is brought before the House or Senate by the
Sergeant-at-Arms
, tried at the bar of the body, and can be imprisoned in the Capitol
jail.The purpose of the imprisonment or other sanction may be either punitive11 or
coercive.12 Thus, the witness can be imprisoned for a specified period of time as
punishment, or for an indefinite period (but not, at least by the House, beyond the end
of a session of the Congress) until he agrees to comply."

But there is no "Capitol jail" apparently and this session will not last much longer, so that is pretty weak.

As far as authority, it is Congress itself. If this would have happened when Clinton was president and the Rpig house cited someone in his administration, they would have had the offender in leg irons and an orange jumpsuit. (Sergeant at Arms would do the arrest.)

Harriet Miers and Josh Bolten were found in comtempt of congress, and they were referred to the DOJ. Nothing has been done about it. So forgive me if I'm not overexcited. Tell me that he was guilty of inherent contempt and I will be jumping up and down.

WASHINGTON — The Senate Judiciary Committee voted for a contempt citation against presidential confidants Karl Rove and Josh Bolten on Thursday, the latest move in an inquiry into possibly politically motivated firings of federal prosecutors.

The 12-7 vote sent the citation against the two to the full Senate.
Majority Leader Harry Reid told reporters afterward that he will consider whether to bring it to the floor next year.

Rove, the architect of President Bush's two campaigns for the White House, and Bolten, the president's chief of staff, have refused to comply with subpoenas demanding testimony and documents in the congressional probe.

Rove, who recently left government, and Bolten claim the information Congress demands is off-limits under executive privilege. Lawmakers in both the House and Senate dispute that.

The Senate Judiciary Committee vote means that contempt citations against Bush administration officials await floor action in both chambers of Congress.

It's not clear they will advance any further.

Even if the citations receive floor votes, the issue likely would land in federal courts in a drawn-out constitutional showdown over what White House information should be made available for congressional oversight.

So, Congress as a whole has filed contempt on this guy and
nothing happened.
Not a damn thing.
And when Senate filed contempt last year, the "inherent contempt" issue was immediately raised on the blogs.

60. Raising hell about McDeath. He did me a big favor when he
called Social Security a disgrace. Kinda difficult when you have people who depend on the $800. a month and the medical care while he pulls down 23K a year from SS, 58K from his veteran's disability, 168K from the Senate and lifetime socialize medicine to rally support for his plans to wreck SS.

I always end the my tirade with Fark Him. I get a big Fark Him in return. And I live in a red state.
