Phil Lindsey was looking forward to his day in court Thursday.

But he will have to wait at least another six weeks. His trial was continued to Oct. 22, as per the prosecution’s request.

Lindsey, a known voting rights activist from Independence, was in court defending himself on a charge of “disorderly conduct” at his local polling place in August.

Lindsey was arrested after his identification was rejected by election judges and he refused to leave the premises until he could vote. He said judges insisted he show a signature ID if he wanted to cast a vote and would not accept the forms of ID he gave them – a postcard notification from the election board bearing his name and address and a utility bill. He also produced a bank statement. All of the IDS he presented are acceptable forms of ID under Missouri state law.

When Lindsey refused to leave, a 911 call was made by one of the election judges to the Independence Police Department.

Lindsey entered a not guilty plea in court but witnesses from the prosecution – representatives from the Jackson County Election Board and the Kansas City, Missouri Police Department – were not present. Independence City Prosecutor Mitch Langford requested the continuance.

Lindsey said the Missouri Secretary of State’s Office also requested Charlene Davis, Republican election director at the Jackson County Election Board, link the JCEB Web site to the state’s Web site so voters would have access to acceptable forms of voter ID.

“But she refused,” he said.

Davis confirmed this.

“The SOS did call to link ‘what you need to vote’ with our ‘what you need to register.’ But you can’t link that. It’s apples and oranges,” she said.

However, when it was pointed out that registered Missouri voters cannot find any information on the JCEB Web site on what ID is accepted at the polls in order to vote, Davis agreed to upload the information to the site.

(Too busy with my damn JOB. LOL)

2. Any lawyers out there want to comment on the reason why
the prosecutors, and or witness are no shows, and court date is postponed? And legally how long can they prolong this? I thought that a speedy trial was a right?

16. "speedy trial" is not the same as "prompt trial"

The trial is to be conducted with due dispatch.

When you might get to trial is another story.

Continuing a trial to ensure availability of witnesses is not unusual, and not having them on hand would not afford a speedy trial.

How convenient of the Board of Elections to create a charge that would result in stripping
Phil of his right to vote. What a load of unadulterated nonsense this is.

Wonder how many hands it will take to count the elections irregularities in this voting district
come November. That's probably why they delayed it. They don't want their dirty laundry exposed
in enough time to stop whatever it is that they have up their sleves.

14. Thanks for posting this, Proud! I went to the courthouse with him and was all
fired up, then totally disappointed that it was postponed. I thought if they didn't show, you won by default. Guess not. I do like his attorney tho, he is just as incensed about this as we are. Looking forward to October 22nd (9:30 am, if you can go!). It was great to get the press coverage as well!

Citizens should not have to FIGHT for their RIGHT to vote. They should not have to wait. They should not have to be challenged or excluded, without notice and cause.
