McCain, Palin causing "anxiety, grave fear": Kansas City attorney files suit against McCain

A Kansas City lawyer and supporter of Barack Obama for president has filed suit in federal court, alleging that the Republican ticket has incited violence against the Democratic nominee.

In her suit against Sen. John McCain, Gov. Sarah Palin and campaign manager Rick Davis, Mary Kay Green said she has been injured by their campaign tactics and suffers “terror of the heart, anxiety and grave fear” for Obama’s life.

Green, an occasional contributor of letters to the editor for The Kansas City Star on legal and political issues, said the GOP campaign has used false hate speech to work their supporters into a frenzy, leading to death threats against Obama.

In an interview, Green said she worked as a young woman in the presidential campaigns of both John and Robert Kennedy in Nebraska. Though she has asked for $6 million in damages, Green said the money is not important. The suit is a moral plea to the Republicans to temper their language, she said.

I know three artists, who aren't able to work effectively because of the poisonous atmosphere, of the political campaign.
This of course on top of having had our incomes totally marginalized for the past 8 years due to class warfare waged by the Repigs!

20. I think it's a STELLAR idea. They're threatening, bullying, intimidating, and harrassing.
They've done this for years, but it's amped WAY up because they see the writing on the wall and it's making them desperate. And the problem is - desperate people sometimes do desperate things - UNLESS they're stopped.

I think it's not such a bad idea that we threaten, bully, intimidate, and harrass them BACK. Tit for tat. Show them how it feels to be on the receiving end.

It's like with anything else: No accountability? They'll do whatever they want because they know that lack of accountability will let them get away with it. No consequences? No problem! Do your shittiest! And enjoy the free ride you'll get for it! Nobody's gonna do anything about it.

Well, THAT is just WRONG, WRONG, WRONG. It's why they ARE doing this shit and it's why they WON'T stop. Because nobody's FORCED them to stop whether they like it or not. Nobody's made a big enough stink. Nobody's made a stink with teeth in it. Nobody's tried to do anything to MAKE them stop ('cause they sure won't stop voluntarily - or because it's the correct thing to do). And they won't til they're made to stop. They won't stop until or unless it becomes just too big a hassle or too potentially expensive or messy or there's too much bad publicity shining a bright light on the shit they like to pull in the shadows.

If they started staring this kind of complication in the face for what they've done, maybe it'd make SOME of them think twice before trying to start something else. They haven't had ANY reason to stay away from this kind of activity. Nobody's made it untenable or unthinkable to do these things before. Until now, when SOMEBODY finally decides to fight back - in a way that just might hurt a little.

Lawsuits? How about a hundred of 'em? How about a class action suit? And all the publicity that comes from it, including a rehash of all the violent campaign exhortations and supporters' shouting angry, hostile, deceitful, even flat-out murderous things to remind people of why this is so evil and awful and reprehensible and why we HAVE to do SOMETHING to make it stop?

I think this is a great idea! I just hope it's not the only one. We should be hitting them back in every way we can imagine. Like they always said in sparring class: Keep jabbing. Keep punching. KEEP 'EM BUSY.

I go out doorbelling and working on Obama's behalf all the time and I can tell you some of the shit pitched at me...makes me cringe...I do fear for my safety sometimes!!!

I think people who call for Obama should have recording devices on their phones.

If I was phone banking, I would record--and if I got nasty feedback, I would call
the mainstream media reporters who cover politics.

You could get a lot of coverage. TV follows newspaper, so start with the NYTimes--and
then give the audio tapes to CNN, MSNBC.

If enough people did this--this would definitely be a story.

Consider doing this.

Those records are under $50 at Radio Shack.

8. I have a friend who said she is afraid to vote for Obama because of the risk it might put him under.
She has not been eating or sleeping well because she is seriously worried we are heading toward severe chaos related to racial conflicts. I think there is some real seriousness to the level of stress this behavior is causing.

They are playing with fire.

As a full-time plaintiff's attorney who represents people who have experienced actual, severe harm - it annoys me to see anyone reduce our civil justice system to a platform for cheap, silly PR stunts. This kind of BS trivializes the cases of people who have been grievously harmed and have nowhere else to turn.

I gotta call 'em as I see. I'll be slipping into my asbestos suit now, so let the flaming begin.

43. It's not BIAS, it's KNOWLEDGE.
You cannot simply sue for anything that disturbs your Chi.

A lawsuit must meet certain standards, among them, the person asserting the claim must have proper standing to sue the person they sue. They must prove that the person they're suing has a duty under the law to such plaintiff. They must prove that the person sued has breached such a duty, that harm has come to them, and that damages or injury result proximately from such action.

There's a reason people have to go to law school and pass the bar exam to become lawyers. Knowledge matters. A lawsuit is more than a letter to the editor with a subpoena attached. Every complaint in life does not produce a basis for a lawsuit.

36. It bothers me that it's not being addressed as a criminal issue, not a civil one. This suit


is in civil court, but I'm just pretty darn sure that incitement to violence is a criminal offense. So why is this not being dealt with as a criminal matter? At the very least, why is the Secret Service allowing this to go on? These are threats being made against a presidential candidate; a person under the protection of the Secret Service. So why is the Secret Service not putting a stop to this crap?

40. Dismissed. Lack of Standing. No justiciable controversy. Political matter.
The list of reasons this case will be dismissed is a long one. She'll be lucky if she's not sanctioned by the court for filing this frivolous lawsuit.

Every complaint in life does not create a lawsuit, only the ones that rise to the level of being a cause of action under the law. She lacks a cause of action, and she lacks standing to file such a case.

It's a bullshit case. Sorry.
