About Marijuana laws. . .

On Tuesday, largely under the radar of the pundits and political chattering classes, voters dealt what may be a fatal blow to America's longest-running and least-discussed war -- the war on marijuana.

Michigan voters made their state the 13th to allow the medical use of marijuana by a whopping 63 percent to 37 percent, the largest margin ever for a medical marijuana initiative. And by 65 percent to 35 percent, Massachusetts voters decriminalized the possession of up to an ounce of marijuana, replacing arrests, legal fees, court appearances, the possibility of jail and a lifelong criminal record with a $100 fine, much like a traffic ticket, that can be paid through the mail.

This is very good news for all sensible people. Further down I found this:
. . . . warned of rampant drug abuse and crime should the measure pass, simply ignoring the fact that no such thing has happened in the 11 other states (including California, Ohio and New York) that have had similar laws for years.


This is TRUE? New York has made up to an ounce a ticketing offense?

How long ago? Which administration?... and most importantly

WHY DIDN'T ANYONE TELL ME??

I believe if in possession of less than an ounce you get fined.

2. I guess that explains it. .
My kids would have been 9 & 11. .

I was really busy and I know that stuff wouldn't exactly be running on the front pages

And they were too young to have been paying any attention to that stuff...

But NOW they're old enough to send shopping!

3. Being the info geek that I am, I was trying to search exactly when this happened

on the net, and maybe because it's been law for so long now, it's hard to find the year. My kids are about the same age as yours so they weren't aware, but my best friend's kids were of age back then! lol!

As to sending them shopping...lol! My lips are sealed!

Details

Possession of 25 grams or less of marijuana is punishable by a fine of $100 for the first offense. For the second offense, the penalty increases to a $200 fine and for subsequent offenses the fine increases to $250 and a maximum of 15 days in jail time may be imposed.

Possession of greater than 25 grams or possession of any amount in public where the marijuana is burning or open to public view, is a class B misdemeanor and is punishable by up to three months in jail and a fine up to $500.

For possession of greater than two ounces, the penalty increases to a possible one year in jail and a fine up to $1,000.

Possession of greater than eight ounces increases the penalties to a possible one to one and a half years in prison and a fine up to $5,000. The penalties for possession of greater than 16 ounces are one to two and a half years in prison and a fine up to $5,000. For possession of any amount greater than 10 pounds, the penalty is one to five and half years in prison and a fine up to $5,000.

Delivery or manufacture of two grams or less of marijuana for no remuneration is punishable by up to three months in jail and a fine up to $500. For delivery or manufacture of 25 grams or less, the penalty is up to one year in jail and a fine up to $1,000. For amounts greater than 25 grams, the penalty increases to one to one and a half years in jail and a fine up to $5,000. Delivery or manufacture of greater than four ounces is punishable by one to two and a half years in prison and a fine up to $5,000. For any amount greater than 16 ounces, the penalty increases to one to five and a half years in prison and a fine up to $5,000.

Any sale or delivery to a minor is punishable by one to two and a half years in prison and a fine up to $5,000.

Possession or sale of paraphernalia is punishable by up to one year in jail or a fine up to $1,000.

Decriminalization: The state has decriminalized marijuana to some degree. Typically, decriminalization means no prison time or criminal record for first-time possession of a small amount for personal consumption. The conduct is treated like a minor traffic violation.

detains people found with personal amounts. But why am I not surprised?

I'm north of the city and I know a few people who have received summons and have never heard of one detention.

In 1977, New York State decriminalized possession of personal use amounts of marijuana. Nonetheless, researchers report that New York City is now the national leader in detaining individuals for possession of personal use amounts of marijuana.

Beginning with the advent of quality of life policing, the New York City Police Department dramatically increased the number of arrests for marijuana possession: from 1997 to 2006, the department arrested 362,000 people for possessing marijuana; in 2006 alone, it arrested 33,000 people for marijuana possession. The department also commonly holds marijuana possession arrestees in detention for up to 24 hours pending arraignment.

Published research indicates that the marijuana possession arrests are not in central business districts, and that the police primarily make the arrests in black and Hispanic neighborhoods.

7. NYPD charges people with public consumption...
instead of just possession. That way, they get to lock them up in their stinking cells for an average of 24 hours before they are released. NYC at some points in recent history has accounted for 10% of all pot arrests nationwide. And guess who's getting busted. Clue: It ain't white guys in Manhattan. It's young people of color in the boroughs.
