Biscuit company ordered to rerun union election

A federal appeals panel has ordered Consolidated Biscuit Co. to comply with a National Labor Relations Board order requiring a rerun of a 2002 union representation election at a cookie factory in McComb, Ohio.

A plant spokesman said the company would have no comment on the decision from the 6th U.S. Circuit Court of Appeals in Cincinnati.

The Bakery, Confectionery, Tobacco Workers, and Grain Millers International Union lost the election, 286 to 485. But the NLRB ordered a new election, citing unfair labor practices by plant officials.

The company appealed. The appeals court decision, issued this month, also requires Consolidated Biscuit to reinstate two fired union supporters, Bill Lawhorn and Russ Teegardin, according to a statement issued this week by the union.

Where the National Labor Relations Board is actually responsive to Labor, rather than capital. And where it doesn't take six frickin' years to get a ruling.
