K&R this post if you believe Burris should be seated.
The Republicans would have called the entire Blagojevich story politically motivated, would have claimed there was no crime committed and everyone is innocent until proven guilty. They would have attacked and discredited the prosecutor by now, and would have already accepted and seated the legally appointed nominee.

K&R if you think Burris should be seated.

2. Of all the issues
for Reid to take a firm stand against, this one takes the cake. Good grief.

Blagojevich may be scum but he is still the sitting governor and it doesn't appear that Burris is likely to be under indictment for anything. Seems like Reid is taking guilt by association to a new level.

Burris may be a bit of a flake but no more so than many other sitting Senators. I think the Democrats need to let this one go and work on fixing the economy and maybe, just maybe investigating BushCo for some real criminality.

I'd estimate that by Friday, at the latest, the Illinois Supreme Court will order him to affix his signature.

and it would have come out by now if there were--Reid would have been the first to use it as justification for denying Burris his seat. Besides, as another poster said, Burris is the Mr. Clean of Illinois politics. I lived 38 years in that state and during the last 5 or 10 was really involved in state and local politics. I heard all the dirt on everyone--but Burris was clean as a whistle.

Republicans are who they are, and once the electorate finally caught on they were soundly defeated during the past two election cycles. Using Republican tactics to justify seating a Blagojevich appointee would only serve to make Dems look like Republicans. Blagojevich is worse than kryptonite and he needs to resign or be removed from office so that a successor can make the appointment free of whatever motivations the outgoing crook might have had up his sleeve. If Burris gets the nod from the new governor, then and only then should Senate Democrats roll out the welcome mat.

This is a chess game, so do we really want to set this precedent? Think about that bleak day when the Republicans will inevitably be back in power. Do you want them to refuse to seat a Democratic Senator-designate and use this as precedent?

If the Republicans had a governor's seat and their governor legally appointed a person to the senate would they refuse to seat that person? Hell no. So why are the Democrats, who WON the last election, still acting like a bunch of losers?

Reconsider. At this point, under the ridiculous leadership of Reid and Pelosi, being mistaken for a Republican isn't as bad as it once was. I'm beginning to be wary of being recognized as a Democrat.

Balkin described the issue this way:


Article I, section 5 reads: "Each House shall be the judge of the elections, returns and qualifications of its own members."

Hence the Senate may refuse to seat Burris for three reasons: because he is not qualified under Article I, section 3, because the election returns do not support him, and because his election was not properly conducted. ... Section Two of the Seventeenth Amendment modifies Article I, section 5. It states:

"When vacancies happen in the representation of any State in the Senate, the executive authority of such State shall issue writs of election to fill such vacancies: Provided, That the Legislature of any State may empower the Executive thereof to make temporary appointments until the people fill the vacancies by election as the Legislature may direct."

Thus, you might argue, the Senate must treat a person appropriately appointed by the executive authority of the state as duly elected for purposes of Article I, section 5.

But that is precisely is the basis of the Senate's refusal to seat Burris. In the Senate's view, Burris has not been properly appointed by the executive authority of the State of Illinois.... {because}, for starters, it looks like the Governor might be corrupt and was trying to sell the seat.

But, you might respond, the Governor has not been convicted of anything. Surely he is innocent until proven guilty.

True enough. But Article I, section 5 does not contemplate a criminal proceeding. Rather, it contemplates that the Senate will be the judge of the circumstances of election (or in this case, after the Seventeenth Amendment, an appointment.).

The Democratic leadership argues that it has the duty to protect the Senate's integrity and that allowing a governor accused of corruption to appoint a senator would taint the body. But that argument is rejected by a growing number of both liberal and conservative legal scholars.

Among the liberals, professor Erwin Chemerinsky, dean of the law school at UC Irvine, writes in today's Los Angeles Times: "Allowing the Senate to exclude Burris on any except the narrowest of grounds would create a dangerous precedent. It could open the door to the Senate or the House overturning the will of the people and excluding representatives under one or another pretext. If Burris -- whose appointment meets the legal test, no matter what you think of Blagojevich -- is not seated, other properly elected or appointed representatives also are at risk."

Among the conservatives, Bruce Fein argues that Blagojevich is still the governor, despite the accusations. In today's Washington Times, he says: "That Mr. Blagojevich was under a dark criminal and impeachment cloud when he elevated Mr. Burris is beside the point. President William Jefferson Clinton did not forfeit his power to appoint, sign legislation, or negotiate treaties during his impeachment ordeal. And Democrats are not questioning Mr. Blagojevich's general authority to discharge his gubernatorial responsibilities until or unless he is impeached, convicted and removed from office. Mr. Burris' appointment has been made a lone exception for partisan political reasons."

question with respect to the Senate's authority to seat or refuse Burris. There are two views, both credible, neither set in stone. Whether the Senate has the authority is a valid question, and it looks like we might get a chance to learn the answer to that question shortly.

...I'm not against what the Dems have done here. They've put up token resistance, and in the end the courts will (if I understand the Illinois law correctly) order that Burris be seated. Welcoming him with open arms would have resulted in a firestorm of controversy. They needed to draw a clean break between the Dems and Blagojevich, and they've done so. Once Burris is seated by the courts, he'll be welcomed into the fold.

right on this. Blagojevich is the duly constituted governor of Illinois. The fact that he has been indicted does not in any way reduce his constitutional powers. In a case such as this, it is the Secretary of State’s job to certify and sign the papers. He does not have the power to act to veto the governors’ action.
For the Senate to try to interfere with a governors’ constitutional powers will set a precedence that will come back to haunt them in future.

I don't care what Republicans would have done, or what they're doing now. But Burris has complied with the law and was legally appointed. He should be seated. Let the investigation of the governor's alleged corruption proceed with due process (as well it should), but don't punish Illinois voters or the legally appointed Junior Senator for Governor Blagojevich's alledged crimes, by depriving them of representation and preventing him from doing the job he was appointed to do.

"I cannot sit idly by as this office continues to pursue the unjust prosecution of Rolando Cruz," she wrote in an impassioned letter of resignation to Burris, who assigned the case to another lawyer in the office. Nine months later, to Kenney's great consternation, the Illinois Supreme Court affirmed Cruz's conviction. But the story still wasn't over. As a result of Kenney's courageous stance, intense attention was now focused on the case, both by the media and by the local community. The deans of six Illinois law schools and a group of prominent former prosecutors filed friend-of-the-court briefs in support of a rehearing for Cruz. In 1994, the state Supreme Court bowed to the pressure and reversed the second conviction, awarding Cruz yet another trial, his third.

As the trial approached in 1995, DNA technology had advanced sufficiently to link Dugan and Dugan alone to the crime.


See bolded excerpts. Should every member of the Illinois Supreme Court be blamed? This is how the criminal justice system in the US works, and it doesn't always work well.

As a state attorney general, Burris followed legal procedure. Cruz was tried twice. Cruz was found guilty twice -- by a jury, not by Burris. When science caught up with law he was pardoned.

My advice to everyone, including Mr. Cruz, is; don't tell police you've dreamed of a crime unless you want to become a suspect and you will avoid all the trouble in the first place.

BTW, going back to 1991 to dig this up as an excuse not to seat Burris is ridiculous. I guaranty we could go back into every senator's past and find a reason to unseat them. They are all human beings and none of them are perfect. This is the type of tactic Republicans are famous for.

His appointment was legal and constitutional. Instead of the incredibly confrontational scene orchestrated by Reid, our party should have taken the high road by saying: "Burriss' appointment is legal and although we don't condone the conduct of his appointer, we are the party that protects the constitution and will do so in this instance also."

What a missed opportunity!

I also think there should be an investigation into the whether there was collusion between Reid and the Illinois Sec. of State to interfere with the right of Illinois citizens to be fully represented in the Senate. If there was, both of them should be removed from office. Behavior like that would be just as bad as what Blagojovich is accused of.

And, by the way, OP, we don't ever do what the Repugs would do -- we do what is right, just and constitutional. Let's all keep remembering that and we'll have the best eight years in U.S. history!!

Coming to DC without his appointment signed off by the secretary of state made him look like a cracked pot to me.

Why would he accept the appointment from someone as dirty as Blago? Guess his standards are just lower than mine, he at least should have the approval of the lieutenant Governor (soon to be Governor) & Secretary of state before claiming to be the junior senator..if he had those two things in his pocket, then Reid should and would have accepted him.

Other than that, Burris should go back and STFU till this gets worked out.

the sec. of state of Il. says "he is being made the fall guy by the U.S. senate--that his signature was not needed to seat Burris".

specifically, impeaching Blago will NOT give Pat Quinn the right to name anyone.

A sitting gov has named someone. If later he gets impeached and removed for something other than improprieties around the choosing of Burris, it's after the fact. Appointment is still legal. Forget it, folks, Roland Burris is the junior senator from IL even if Blago ends up with a death sentence.

There is nothing anyone can do about it. "Taint" is a bullshit word - criminality is human behavior not a communicable disease.

...that Blago is a Republican accused of trying to sell the senate seat. He then appoints a fellow Republican while he is under the "taint" and accusation of corruption. You know damn well we at DU would be screaming from the rooftops that the hypothetical Republican senator appointee he appointed should not be seated. Burris should not be seated for the same reason. Nothing against Burris; I'm sure he is a decent and honorable man. This has nothing to do with Burris and everything to do with Blago. I also have lost respect for Burris for accepting the seat even after denouncing Blago's actions. Call me paranoid, but something is not right there.

I guaranty the Republican appointee would be seated immediately. The Republicans wouldn't make a spectacle of themselves, a laughingstock.

That's the real difference between our parties. Republicans rely on the law to exercise their rights and when the law doesn't work for them they ignore it and do what they want to do anyway -- all the while opposing our legal rights. Democrats refuse to stand up to Republicans even when they have the law on their side. Worse than that, Democrats are actually doing the Republicans' dirty work for them by refusing to seat one of their own with the law on their side!

Republicans aren't stupid. They're laying low and allowing Reid and the Democrats to keep digging the hole they've dug for themselves deeper and deeper.

Hey, Harry, when you find yourself in a hole -- the first thing to do is, stop digging.
