Tax Refunds Now on Hold in California

ABC News has learned that tax refunds are now on hold in California for the first time in state history, according to the state controller's office.

"Unfortunately, we have asked the California Franchise Tax Board not to send over tax refund claims beginning today because we will not be able to process them and have them out the door by Feb. 1 when a 30-day delay in tax refunds goes into effect," Hallye Jordan, spokeswoman to California State Controller John Chiang, tells ABC News.

During the 30-day delay, the controller's office estimates that a combined 2.74 million California individuals and businesses will have their tax refund delayed.

The controller's office estimates that the delay in tax refunds will free up $1.99 billion over the next month to pay for education, debt service, and other payments that legally have first claim to state funds.

I did a search in GD and didn't see this discussed. The California Comptroller characterizes this as a 30-day delay in issuing tax refunds. OK, the 30 days expires. What then? Will California suddenly find the money it needs to pay these refunds? Will TARP money be provided?

1. great, they'd better be paying interest and penalties on it
since they would treat me in kind should i have a reason to not be able to pay them.

2. Theft
Not paying refunds in a timely manner is theft, stealing.

The money collect that was to be refunded should never, ever have been spent -- maybe invested to earn interest, but never spent in the first place.

3. start tinkering with the "full faith and credit" clause, go ahead. I know it's a state, but
California's bigger than a lot of countries.

4. Our money problems will never go away as long as Arnold is our Governor.
He needs to be recalled for doing a crappy job of fixing our budget problems, the same reason Grey Davis purportedly was recalled. Never mind that Grey inherited his budget problems from Pete Wilson and they were exacerbated by Enron and our energy crisis during his term. Maybe when everyone gets hit by our budget crisis, Californians will rise to the occasion. We actually need to find another Jerry Brown to be Governor, a man who created a budget surplus during his time as Governor in spite of the Republicans doing everything they could to undermine him during his terms.

I can't afford it either. So, we'll be even.

I wonder if they'll be paying interest and penalties to the people they stiff on refunds. I know that if I were owed a big refund, I'd file a freaking lawsuit.

OTOH, expect a lot of people to change their withholding, so there's no chance they have a refund coming next year. Why take the chance Ahnuld will steal it from you.

As Gov. Arnold Schwarzenegger orders steep salary cuts for most of the state workforce, some Sacramento players are doing much better by him.

The governor has added state legislators and former political aides to the state payroll, with six-figure salaries. Their positions: plum posts on the same state boards and commissions that the governor crusaded to abolish a few years ago, calling them a waste of taxpayer money.

Two GOP lawmakers who recently left office and have limited expertise in thorny employment issues have received jobs at the state Unemployment Insurance Appeals Board. The panel met 12 times last year, and members are paid $128,109.

"It's a soft landing spot for ex-elected officials who can make a good living while showing up 12 times a year," said Joel Fox, an antitax advocate who worked on the governor's aborted plan to shut down the boards. "The positions should be eliminated."

Seats on state boards have long been awarded to lawmakers loyal to governors and legislative leaders.

But Schwarzenegger made the most recent appointments just days after ordering 238,000 state workers to be furloughed two days a month or take an equivalent pay cut of about 9%. He also requested that the state payroll be reduced an additional 10%, including layoffs if necessary.

6. Just ask the State to apply their IOU for your refund to your future tax obligation. . .
that would certainly test the "full faith and credit" of the State's obligation to make good on its promises.

I always try to get my state taxes as close to even or owe a slight amount.
