Hirsch Proposes Impeachment Trap To Stop Bush Nuclear Attack on Iran

Jan. 20, 2007 (EIRNS)—University of California-San Diego Professor Jorge Hirsch argues, in a column posted on antiwar.com, that Congress has the Constitutional authority to stop a Bush-Cheney nuclear attack on Iran by making it illegal for the U.S. to use nuclear weapons on a non-nuclear weapon state without Congressional authorization.

Hirsch says that other means that have been suggested aren't viable because, under the War Powers Resolution and the 1948 NSC-30, the President has the legal authority to wage war for 60 days and to decide whether or not to employ nuclear weapons in the event of war. But if Congress acts as he suggests, "Bush will not dare putting 150,000 American lives in Iraq at risk of Iranian retaliation without having the nuclear option on the table."

Hirsch argues that Bush "would not be able to ignore such a law without committing an impeachable offense." If Congress does not act, Hirsch warns, then each member "will share responisbility for the nefarious chain of events that is likely to follow..."

4. There are lots of ways to reign in a rogue administration...
...things they can do legislatively and things they can do as individuals with media access. I don't for a minute buy that their hands are tied, or that their options are limited. They can

hold oversight hearings on past misdeeds (they are, but only on a small fraction)
hold hearings on policy going forward
pass laws
pass resolutions
begin impeachment
file lawsuits on a variety of matters (get ruling on constitutionality of signing statements for example)
set up weekly primetime addresses to discuss what's really going on
lead marches
shut down the government or hold up key aspects of government function
threaten corporate sponsors who lobby for a chance at war or environmental profiteering
hand deliver millions of signatures to the WH
look into the World Bank and its role in empire building
full page ads in national periodicals
suggest the public read certain books that shed light on the last 6 years
be honest and frank about how bad this administration has been. Don't mince words.
Point out the failures in all policy areas..build a huge, comprehensive case against them

The degree of pressure they can bring, behind the scenes or with the public, is considerable. We can't know all that's going on, but these foreign policy issues are serious enough that we should expect to see a HELL of a lot more than we are.

The vigor, creativity, ruthlessness, determination, and sometimes brilliance with which this administration has approached corporate empire building MUST BE MATCHED NOW BY THE CONGRESS THAT IS SUPPOSED TO REPRESENT US. I hope that's what's going on....This is end-of-the-world-as-we-know-it type stuff...not a time for tip-toeing.
