Many people have repeated the false claim that EFCA takes away workers' precious right to a secret ballot.

How can it take away a right that workers don't have?

If people are so concerned about being entitled to a secret ballot election, why isn't ANYONE lamenting the status quo, under which workers are NOT entitled to a secret ballot?

MYTH: The Employee Free Choice Act abolishes the National Labor Relations Board's "secret ballot" election process.

FACT: The Employee Free Choice Act does not abolish the NLRB election process. That process would still be available under the Employee Free Choice Act. The legislation simply gives workers the choice of forming their union through an election or through majority sign-up. The majority sign-up process has been a widely used path to union representation since 1935, but workers may only use the majority sign-up process currently if their employer agrees. The Employee Free Choice Act puts that choice in the hands of employees rather than their employer.

4. You're parroting right-wing anti-union talking points again.
We've been over this over and over and over. EFCA gives the EMPLOYEES the CHOICE of having a secret ballot election if they want one. That choice is currently in the hands of the corporation, which will always choose the method which enables them to do the most union-busting.

If you're too fucking stupid to get this through your thick fucking skull, go back to Free Republic, where your stupidity will be more welcome.

Excuse me?

I was a 15 year member of the NALC. How fucking dare you insinuate I'm some moron who doesn't understand the situation? I know full well what happens in companies when employees want to join a union. I also know first fucking hand what happens to employees who don't want to join. That's why a secret ballot is important. If presented correctly, the majority of employees will see that collective bargaining is a huge advantage to them. Anonymity protects employees who want to unionize and the few who don't.

First, you claim to be part of a union, then, you go right to insinuating that unions intimidate those that they want to make members. What are you smoking?

And you're glossing over the employer's campaigns of intimidation, coercion and disinformation that includes firings of union activists and threats to close the site if employees vote to unionize that routinely take place in the current "secret ballot" process, which has been so corrupted by big-business that it's anything but democratic.

Fundamentally, "card-check" is nothing more than a petition drive. And yes, if 30% of the employees in a company want it, they can do a secret-ballot election instead of a card-check petition.

10. Doubt me all you want.
I've got 15 years experience with unions including 3 as a shop steward. You can go ahead and call me a liar all you want. For all I know, the only thing YOU know about unions is what you've seen in the movies or on television. And yes, employees do intimidate other employees. I've seen that first hand with two Letter Carriers who refused to join the union yet were perfectly happy to sit back and enjoy the raises we received from our negotiations. I had to threaten with legal action a group of employees who were constantly harassing them when it escalated to the point where those union members slashed the tires on the non-members vehicles. 3 members out of a 47 member shop decided they were going to make life hell for those two non members because they adopted a mob mentality and thought they were justified in taking matters into their own hands. Yeah, it does happen. And it's NO better than when management intimidates employees and threatens to close down if the membership votes in a union. The secret ballot protects members from their employer and their coworkers.

The bill KEEPS the secret ballot, but ALSO allows majority sign-up elections to form a union. Read the fucking bill!

It's just more republican and corporate bullshit....why is every fucking republican against it...cause the slimy republicans love & support workers rights to have a strong union voice? Get fucking real dude!! Why are corporations spending hundreds of millions of dollars to defeat it and Fox news and every other republican media source telling lies to defeat it? The same lies that you believe!

I've been union (IBEW Local 551) far too many years to believe the republicans bullshit & lies, republicans don't care one shit about workers right, benefits or worker safety, these huge corporations like Wal-Mart and many other corporations threaten their workers against forming unions as well as against this bill...Read the bill....

A proper election is only held if the organizers can't get 50% of the employees to sign signature cards. If you honestly believe there is no possibility of coercion and/or harassment to get that 50% and avoid a formal election, you probably also believed Iraq attacked us on September 11th.

I don't support card check because it emboldens bullies. An employee who hasn't committed is subject to threats and harassment from BOTH FUCKING SIDES. The last thing I want is for management to know who is voting for or against. I also don't want union organizers to know either. All employers aren't evil and greedy and all employees aren't pure as the driven snow. It's childish to believe they are.

5. Cingular wireless workers organized without a secret ballot
because CINGULAR chose not to have it. What happened to the precious right to a secret ballot which big bad EFCA is taking away from us?

13. Exactly. All EFCA is doing is putting the choice where it belongs -with the workers themselves
There's no reason why the employer should have any say over whether or not the ballot or card check is used when workers want a union.

If enough employees request one by singing up for an election. It doesn't guarantee the election will be successful.

12. Actually, if the workers want a union they could do it without an election now if the employer
doesn't force the issue. But most do because they know they can fire organizers, use company time to misinform and intimidate workers and generally do everything they can to bust the union.

You don't know what the hell you're talking about.
