Coleman Lays Out Appeal Strategy Pending Recount Decision

Republican Norm Coleman is hoping for the best but preparing for the worst in his challenge of the Minnesota Senate race outcome.

As the recount trial wrapped up and judges set to begin to deliberations, Coleman’s attorney’s distributed a memo Friday laying out a two-track strategy which they say has the former senator “poised ... to be sworn into the U.S. Senate.”

Coleman, whose first term expired in January, is fighting a recount outcome that put Democratic challenger Al Franken ahead by 225 votes out of 2.9 million cast.

The memo says that Coleman could take the lead if the judges hearing the recount case over the past seven weeks “embrace the Minnesota tradition of enfranchising voters and agree to open and count the wrongly rejected absentee ballots.”

Given the judges’ rulings throughout the trial, many local court watchers deem that unlikely.

The Coleman campaign’s other option, should “the judges take a more restrictive approach to counting votes” likely would invove an appeal to the Minnesota Supreme Court.

to appeal under the US and MN state Constitutions.

Once those are exhausted, then he has no further right to complain

Coleman knows he will not and can not win but he is doing the bidding of the RNC and the Senate repugs in keeping Franken
from being seated.

10. There may be a short widow during which Franken might be sworn in
When the judge bangs the gavel down on the current case Franken will be the winner. Very nearly concurrently Coleman will have a lawyer file an appeal in the State Supreme Court. However in the intervening period - which may be as short as a few moments, Franken will be the undisputed winner - and should be standing in Harry Reed's office being sworn in. That would leave Colemam able to challenge the election, but Franken in the Senate. At that point the result of any challenge to the election becomes moot.

11. No he has to be the "Certified" winner before he can be seated
The Secratary of State and the Governor have to "Certify" the election results before he will be allowed to be seated and they have said they will not do so as long as Coleman has his case active.

That is what he is asking to be done.

The law is set.

What he's asking for are exceptions to the law. That makes new laws, doesn't it? Rulings become precedents? And on up to the Supreme Court? If passed?

I think he's done the citizens of Minnesota a huge disservice by depriving them of half their representation in the Senate.

Hopefully, this will end with the state Supreme Court, and he won't try to find some hook to take it further (after all, GWB did just that):

Gee, Franken's attorney could "distribute a memo" too. Why is this news? Coleman is simply trying to sow doubt, the sore loser. All he's doing is playing "dog in the manger." Same schtick, over and over again.

He needs to gather up the shreds of his tattered and torn reputation, put his tail between his legs, and concede. NOW.
