Cop Claims It's Unconstitutional For HIM To Be Tased!!!
Edited on Thu Apr-09-09 10:00 AM by BlooInBloo
BWAHAHAAHAHAHAAA!!!!

Tase his ass.

http://digbysblog.blogspot.com/2009/04/unconstitutional-tasing-by-digby-for.html

A former sheriff's deputy has filed suit against his department, claiming the department violated his constitutional rights.

Former Hamilton County Sheriff's Deputy Ray Robert says a medical condition prevented him from being exposed to the electric current of a stun gun. Being shocked by the gun is common, mandatory training for officers to carry one in many departments. The 50,000 volts of current exchanged lets officers know first-hand exactly what kind of pain they're inflicting....

One wonders if people who are tased for being in the wrong place at the wrong time --- or just because they pissed off the police officer --- would have the opportunity to mention that they had a metal plate in their head --- or if they would be believed? I don't think so. Police are told they can shoot first and ask questions later.

...

And yet he wants to be able to carry one and use it without having a clue as to the medical condition of his subjects. His bosses don't think there's any reason to question using such a weapon on an unsuspecting public since they all have submitted themselves to tasing. (Of course, that can go very wrong as well.) But even if it's done without incident, it's nothing like what happens on the streets. Like those people who submit themselves to waterboarding and claim it isn't torture, these officials fail to recognize the terror of being on the receiving end of such a device and having no control over the situation. Which is really the point of all torture --- to remove free will.

This officer feels it's unconstitutional to force him to submit to the taser. Yet he and his fellows do it every day to citizens. I'll be curious to see how a court will view all that.

EDIT: Stopped being a lazy ass and put the @!#$#% div tags in.

2. The way to limit the use of tasers is to make it illegal ot tase an unarmed man.
Having cops got tased as part of training hasn't stopped their over-use.

3. If his medical problems are THAT serious, WHY is he still a cop?
It's not fair -- if he cannot handle being tased because of hardware, then at the least he should be deskbound, so he doesn't have to use a taser.

I have a medical implant, and the thought of some pissed off cop tasing me scares the shit out of me. My stuff is wired right into my spine. I doubt the police will pay for medical bills caused by overloading my implant, and possibly damaging me further.

If he can't handle it, he should retire.

4. If you are unable or unwilling to endure the training requirements then find another job.
You don't have a Constitutional right to be a cop.

5. If he has a plausible medical condition then he should be allowed to skip it and take a course
On the useage of taser and when it is appropriate. When I was in the military, those who weren't medical able to go through a CS Gas chamber didn't have to and still graduated basic training. Though I doubt it is unconstitutional.

7. I heard his supervisor talking on "As It Happens" on the radio tonight. He
said what pro-taser people always say: "when people die after being tazered it is because of some underlying condition not the tazer". That sounds exactly like some corporate way of looking at it. Sure enough the supervisor admitted he had had discussions with the ceo of the tazer corporation.

If 2% of people have say a heart condition that makes them vulnerable to death after being tazed then that should be taken into consideration and not ignored.

Just how I feel.

8. Do they stand in front of a
Bullet to see the damage? Do the older cops go through this if they use tasers? They need something that just gives that tingling feeling but not deadly. Like the old machine in the arcades of "How long can you hang on". That was harmless and it got your attention. And if they go for your legs they collapse like they're asleep so you can't move.
