Bush Overides Congress and "Recess Appoints" Switboater Fox as Ambassador to Belgium!

Just now reported on CNN. I thought it was posted last week that Fox "withdrew" his name over Dem objects...but it seems that the Chimperor said: "Hey Buddy, no way I'm not gonna reward you for takin' down John Kerry singlehandedly....Youah gonna get that big job I promised you." :grr:

UPDATE: Here's Kos and WaPo's prediction that Bush would Recess appoint Fox. I can't find the link to his appointment announced on CNN by Blitzer fill in Malveau...still looking but I'm sure it's out there..maybe on CNN's website by now.

4. He also appointed some RW Harridan to the EPA as a "Recess Appt." yesterday, but
I can't remember the woman's name. Congress had disapproved of her and he just went ahead and did it.

We need to keep a list. That's why I'm afraid every time Congress recesses Bush marches his agenda forward inspite of everything. He still has time to do much damage.

9. I thought Congress had to be in recess for longer than a certain
number of days (10 days?) in order for the prez to make any recess appointments? And I THOUGHT that this Congress wasn't going to be away for that time period purposely in order to prevent * from making any more recess appointments.

I think the House recessed Friday and doesn't come back until the 12 or 13th

so it might fall within the timeline. The Senate seems to be only taking a week recess...but I guess it's the House that counts. :shrug:

The Constitution does not specify the length of time that the Senate must be in recess
before the President may make a recess appointment. Over the last century, as shorter
recesses have become more commonplace, Attorneys General and the Office of Legal
Counsel have offered differing views on this issue. Most recently, in 1993, a Department
of Justice brief implied that the President may make a recess appointment during a recess
of more than three days. Appointments made during short recesses (less than 30 days),
however, have sometimes aroused controversy, and they may involve a political cost for
the President. Controversy has been particularly acute in instances where Senators
perceive that the President is using the recess appointment process to circumvent the
confirmation process for a nominee who is opposed in the Senate.

The House needs a rule (6+ / 0-)


that allows the Speaker to suspend a session without recess. This would allow Congressmen to go home when they need to, without having someone stay behind with a shotgun to keep the fox out of the henhouse. Then there would technically be no recess appointments. Someone correct me if I'm wrong, but can't this be done by majority vote?
