Pawlenty was not ordered to sign, and Pawlenty said he would sign if ordered.

The spotlight in the U.S. Senate contest now shifts to Gov. Tim Pawlenty. The justices said Democrat Al Franken is entitled to an election certificate -- but they did not directly order Pawlenty to issue one.


The Minnesota Supreme Court ruled today that Democrat Al Franken won the U.S. Senate election and said he is entitled to an election certificate that would lead to him being seated in the Senate.

"Affirmed," wrote the Supreme Court, unanimously rejecting Republican Norm Coleman's claims that inconsistent practices by local elections officials and wrong decisions by a lower court had denied him victory.

2. I expect we'll see him sign the certificate shortly.
The winds are not blowing in a favorable direction for him to put it off after this ruling.

3. Correct, he was not "ordered", but on MN Public Radio I heard them say they believe he will sign.
He would not want to place himself in the middle of a legal battle. The highest court in his State has unanimously ruled that Franken should be certified as the winner, so the betting is that Pawlenty will not defy that court and he will sign.

national aspirations.

I'm less worried about certification by Pawlenty than by what GOP senators may pull -- of course, that could involve plotting with Pawlenty.

9. Pawlenty had said something about not signing when there were still court options
Since Coleman conceded, there will be no more court challenges, so I think Pawlenty will sign it. I heard Coleman give his speech, and he did congratulate Senator Franken. At least he had class in the end.

“The Minnesota Supreme Court has today addressed the issues surrounding the accuracy and integrity of our election system during the 2008 U.S. Senate race in Minnesota. In light of that decision and Senator Coleman’s announcement that he will not be pursuing an appeal, I will be signing the election certificate today as directed by the court and applicable law.

“I would like to thank Senator Coleman for his service. As state solicitor general, Mayor of Saint Paul and United States Senator, he has been an extraordinary leader and public servant for Minnesota.

“I also want to congratulate Al Franken and wish him well as he serves the people of Minnesota.”

14. In principle, the courts should not have ordered. The law is pretty clear. Only if Pawlenty fails to
sign should a court order be pursued (and I think he's now clearly said he will).

Frankly I think the lack of a court order is a good thing - Pawlenty in his next campaign (for whatever office) won't be able to say "I was ordered by the courts to sign" to republicans who criticize him for signing.

The Minnesota Supreme Court has ordered that Democrat Al Franken be certified as the winner of the state's long-running Senate race.

The high court rejected a legal challenge from Republican Norm
Coleman, whose options for regaining the Senate seat are dwindling.

Justices said Franken is entitled to the election certificate he needs to assume office.

When Franken is sworn in, he'll give Democrats a big enough majority to overcome Republican filibusters.

Coleman hasn't ruled out seeking federal court intervention.
