Why is he voting against Sotomoyor? Does he have a reason besides that he's a Republican and you have to stick with stoopid when you belong to that party?

Was it her comment that because she's a Latina who struggled in life so she knows more about the problems of ordinary people? Because she was never tortured?
So he can't vote for her? Is that it?

Why am I surprised? He chose Palin as a running mate for her...looks, I guess? She didn't have clothes, so it couldn't have been that. Since he doesn't object to women in powerful positions maybe it was because Sotomoyor never won a beauty contest? Never shot or skinned a moose? She doesn't have a daughter who got pregnant while still in high school? Because she didn't marry for money? She speaks more than one language well? She had too much experience on the job? She follows the law? What?

and the only thing that is clear is that she is not even remotely a judicial activist. I don't know what her personal opinions are, at least not in detail, but they absolutely do not show up in her legal decisions. I've read many of her decisions, and as a lawyer, I do know a judicial activist when I see one.

She is not. There isn't even a single decision to debate about in this regard. Nada. Yet John McCain, in his statement today, picked the one thing that she does not do, and held it out as his SOLE reason for voting against her. I don't know why - is he more dumb than I realized? He said he was reviewing her cases - does he not understand what he is reading? Or does he just know that none of his base will actually read or understand her decisions, and thus take his falsehood at face value? Did he just make a mistake from which he will rightfully never recover? I think that is what he just did, ie tanked his career. Maybe he doesn't care - lost the last prez election he will run for, and his life is nearing the end. Maybe he simply doesn't care.

Because the one thing he should have done was told the true reason, whatever it was, for how he is voting. Or at least come up with something remotely plausible to those of us with a brain. And he didn't - and he is not alone in doing this. Most of them think most people/voters are just too dumb to figure this out.

Here is his floor statement, and all I can say for sure is that he is right now living in a different universe than the rest of us if he really believes that first line. It is almost sad to realize he said such an outright lie or at the least, revealed his diminished mental capacity:

Again and again, Judge Sotomayor seeks to amend the law to fit the circumstances of the case, thereby substituting herself in the role of a legislator. Our Constitution is very clear in its delineation and disbursement of power. It solely tasks the Congress with creating law. It also clearly defines the appropriate role of the courts to "extend to all Cases in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties." To protect the equal, but separate roles of all three branches of government, I cannot support activist judges that seek to legislate from the bench. I have not supported such nominees in the past, and I cannot support such a nominee to the highest court in the land.
