If the rest of the Senate votes along party lines Sotomayor will be confirmed 64-34
Only six out of the Senate's 40 Republicans have said they will vote for Sotomayor. If all the rest vote no and all Democrats vote yes, the final tally would be 64-34 (ailing Democratic Sens. Edward Kennedy of Massachusetts and Robert Byrd of West Virginia aren't expected to vote).

5. Judge Sotomayor will most certainly gain more than the 58 votes Alito received.
Although I had read media reports suggesting it was an early goal of the White House to have her best Chief Justice Roberts' 78 votes, but that now seems unlikely.

This will actually be a close vote by historic standards, but recent history has shown us the trend may be changing.
