Firefighter Who Shot at Bicyclist Charged

Firefighter Charge Reduced

A Buncombe County grand jury rejects a charge of attempted murder against an Asheville firefighter.

Instead, they've charged 42-year-old Charles Diez with assault with a deadly weapon with intent to kill.

Diez is accused of firing a gun at a bicyclist narrowly missing his head after arguing with him about riding on Tunnel Road.

The bicyclists had his 3 year old son on the bike. The man's bike helmet had a bullet hol(e) through it.

That assault charge carries a sentence from 15 months to 7 years in prison.

A driver, now identified as an Asheville firefighter, shot a bicycle rider because he was angry the man was riding with his child on a busy road, Asheville police said.

The shooting happened Sunday morning on Tunnel Road.

Officers said the victim was riding with his wife and had his 3-year-old son in a child seat attached to his bicycle when a driver approached him.

Police said the driver, Charles Diez, claimed he was upset that the victim was bike riding with his child on the heavily traveled Tunnel Road.

Diez pulled a gun and opened fire, hitting the victim in his bicycle helmet, according to police.

1. How exactly is "assault with a deadly weapon with intent to kill"
different from "attempted murder"? One is premeditated and the other is not? :shrug:

2. Didn't he get the NRA memo? He should have been stopping a home invasion with that gun.
Instead he was out shooting a bicyclist who was out riding with his kid.
But at least nobody stopped him from having it when he needed it to clear the road of riff raff!

The shooter was angry that the man and his wife were making a dangerous decision in riding bikes on a busy road so the shooter decided to kill the whole family in order to save them from themselves. It's all very clear.
