Trans woman: Employer asked for photos
Trans woman Kate Lynn Blatt says her former employer requested a photograph of her genitalia as a condition of continued employment, after questions arose about her use of a worksite female locker room.

At the time of the October 2007 incident, Blatt was employed by Manpower Inc., a global staffing-services agency with a branch office in Pottsville.

Manpower placed Blatt at Sapa Industrial Extrusions, a manufacturer of aluminum products in Cressona, where she earned about $10 an hour as a temporary factory worker.

Blatt worked at Sapa for about a month, before allegedly being told by a supervisor that she wasn’t physically well enough to work at the job and was no longer needed at Sapa, she said.

After being discharged from Sapa, Blatt said she personally visited Manpower’s branch office in Pottsville, in an attempt to return to work.

Irene Kudziela, branch manager of Manpower’s Pottsville office, allegedly told Blatt that a letter from her surgeon documenting her gender-reassignment surgery — along with a photograph of her genital area — would be necessary before she could return to Sapa.

2. Not your genitals that make you M or F, it's your brain
I've worked with people going through M to F and F to M and not all can afford and some don't want surgical change of the genitalia. It's your brain that is the major sexual organ. When will people understand that?

The people who asked for pics are idiots. I'd smack 'em.

20. Not entirely.
There are women out there who have XY chromosomes and don't know it. I'd bet that it's the other way around, too. When things happen in the womb, and we're not sure why, hormones change and can change the sex of the baby.

Whatever S.S. says is the gender is what Employers have to go by and your ID has to match that.

The Manpower Branch Manager should know this. It doesn't matter what a Surgeon says. Birth Certificate needs to be changed after surgery and S.S.. You have to jump through all the hoops and it's a pain in the ass.

Some states allow Transgender people to use their pre-op status for ID but for a job S.S. decides and your ID has to match what they say. In many cases it's best to have an ID with one gender for when you apply for a job your Drivers License for your Transgender ID.

It's too bad that it is that way. A lot of TG people can not afford the surgery and it usually isn't covered by insurance, what a surprise.:sarcasm:

9. She was a temp?
Why did they even GIVE a reason for termination? And, if pushed, just state 'not a fit for our environment'? Because, that would have been the truth. Having worked in a filthy manufacturing environment (I've worked in a facility that manufactured aluminum products) the primary concern over Ms Blatt's sexual identification was expressed by other female employees sharing the locker room.

In my experience, if a temp causes a concern to permanent employees, that temp is GONE.

Which leaves me wondering - is Ms Blatt related to someone who works at Sapa? (And, no, that would not preclude her being a temp. There are companies around here where policy is ALL new hires go through temp agencies.)

Something else that strikes me as being 'off' a bit, Ms Blatt isn't suing for her old job back, she now wants to be a 'diversity' trainer? Nice promotion there. Cushy job out of the dust and grime of daily mfg.

Gender dysphoria is a disability? That's like saying being Irish is a minority.

Did the company handle this wrong? Oh yes, BIG time. Should they pay for hiring an HR idiot? Oh yes. Should they hire Ms. Blatt? No. Give her the court ordered pay out, 'restructure' the HR department and move on.

Ok, flame away.

13. No lawsuit - she will not be set.
Sorry, but she lives in an ironically named "right to work"state. Depending on the state laws, her employer could hand her a gun and tell her to kill someone on the street and if she declined that would be grounds for termination.

Since St. Raygun, this has not been a country friendly to employees.

She has no case. They will pay her to go away and that will be that.

15. Requiring a photograph of her genitalia is open and shut sexual harrassment
Edited on Tue Aug-18-09 10:06 AM by WeDidIt
No way does she come out of this with less than seven figures after court costs and attorney fees.

It could be eight figures.

Had the manager been smart and simply stated "you were emplyed on a temporary basis and your services are simply no longer required" there would be no recourse, but her manager fucked up.

Manpower is the largest temp agency in the country.
