Another iPhone MMS lawsuit surfaces

Another class-action lawsuit has been filed in an Illinois district court against Apple and AT&T under the Unfair Trade Practices Act and other laws in that state.

This second lawsuit accuses both companies of misrepresenting the availability of MMS on the iPhone. According to a report by AppleInsider, the suit uses the same language as last week's similar suit in the state of Louisiana, suggesting that both companies aggressively promoted the not-yet-availalbe MMS features of iPhone OS 3.0 and the iPhone 3GS using advertising on TV, radio, newspapers, direct mailers, and on the Internet. This second suit is larger, however, claiming to represent as many as 100,000 (versus 10,000) people with an economic impact greater that $5 million for the class action.

I'll admit I thought I was getting MMS with 3.0, but I wouldn't sue about it.

1. Uh, oh, watch out for the Mac apologists to come out of the woodwork
I can't believe *gasp*, that a huge corporation (Apple) in conjunction with another huge corporation (AT&T) mislead consumers. I'm shocked I tell... Shocked!

2. Not an Apple problem, its an AT&T problem.
It is my understanding that other carriers worldwide supported MMS at launch, but AT&T has thus far not.

4. If AT&T is the problem, then Apple should have dumped them
as their "exclusive" provider of service. If Apple knew that MMS wasn't going to be supported on the only network the their phones work on, then they shouldn't have advertised that fact.

3. Apple spanked AT&T at the launch of 3.0 and the new iPhone. AT&T sucks.
It's all AT&T.

Apple is the most profitable consumer electronics company in the world.

They are sued by opportunists constantly.

Guess how many of these lawsuits pay off.
