Fat Tony's revenge
Scalia, passed over to head the Supreme Court for a lightweight bushie*, and now this looming fight between the WH and Congress will in all probability wind up in the Supreme Court. Revenge is a dish best served cold, Fat Tony could smile and put the screws to the people who passed him over. This could get interesting.

1. I think they're ALL going to side with Congress. . .
well, maybe no Alito or Thomas, but the rest will, for 2 reasons:

1. Roberts need to think of his "legacy" and he doesn't want to be known as the Justice presiding over the lapdog court. It's bad enough that the Rehnquist Court put him into power and will always be remember as such.

2. In this case, WH is getting a big too big for it's britches. It's OK to run over Congress or the People, but once you get into the law, well, that's "fightin' terms" and their territory. Egos of the Justices is just too big

The Supremes have a lot to lose if they say that the Unitary Executive is all right.

5. Oh, the irony!
These guys aren't stupid. They are well aware of the fact that the GOP has very little chance at retaining the White House in the 2008 election.

That means that whatever presidential powers they sanction NOW for BushCo will be the SAME powers handed to a Democratic president in January 2009, something no conservative wants to see happen.

Rock, meet hard place.
