Argentina Legalizes Personal Marijuana Use

Supreme Court Decision is Part of a Wave of Decriminalization in Latin America


On August 25, Argentina's Supreme Court struck down a dirty war-era law criminalizing possession of even the smallest quantities of marijuana. In the decision, the Supreme Court ruled that possession of small quantities of marijuana for personal use is protected by Article 19 of Argentina's Constitution, which states: "private actions that in no way offend public order or morality, nor are detrimental to a third party, are reserved for God and are beyond the authority of legislators."

The BBC reports that Argentine Supreme Court President Ricardo Lorenzetti said, "The state cannot establish morality," and that private behavior is legal "as long as it doesn't constitute clear danger."

The ruling came as no surprise; it was preceded by public forums in which Argentine judges and legislators called for decriminalization at the international level and lower court decisions that moved the country closer and closer to decriminalization. In 2007, Congress passed a law legalizing medical marijuana.

3. The US is looking more backwards by the day, isn't it?
Not only are we going to be cheated out of what the rest of the hemisphere takes for granted, a public health insurance plan, our government is clinging to the stupid and failed war on drugs with everything it's got.

The conservatives have ruined this country.

13. this is one issue REAL conservatives can come together with liberals on
legalization of marijuana.

fwiw, national review, the conservative flagship has been pro-decrim/legalization for decades.

the problem are the gutless legislators we elect.

they CAN change the law. they don't.

it pisses me off, because the war on marijuana is SO stupid.

i've been a cop 20+ years, and there's actually a fair # of cops i work with (mostly rightwing) who agree about MJ

14. I think most cops on the street are pro legalization
once the reality of what's really going on overrides the DEA training they got as rookies.

The only way to gut unjust nanny laws is through massive civil disobedience along with the lack of will by law enforcement to use them to oppress us.

That has been the pattern with a lot of stupid laws against kissing one's spouse in public, spitting on the street, playing the fiddle on Sunday, and the rest of the silly laws the moralists push in order to create their version of heaven on earth.

The segregationist cry in the 60s that you can't legislate morality is true. You can legislate civil fairness, but you really can't outlaw sin.

It just makes sin more popular when you try.

street cops know that mj users are not the ones assaulting them, shooting them, or routinely committing crimes to get their "fix".

it just doesn't work that way.

and we'd way rather deal with the average stoner, than the average drunk

22. Thanks for the first-hand sharing of knowledge.
I've thought for a long time that this country could be out of debt in a year (or less) if we sold mj over the counter like we do alcohol.

25. my favorite are the headlines
e.g. "cops seize X marijuana plants worth 2,000,000 dollars today in a raid conducted by ..."

so what we did was pay tons of officers straight and overtime (i get over $50 /hr for overtime) lots of hours for investigation, raid , etc. and then tons of hours processing evidence, all so we can destroy a product that we could get TONS of tax money on, that is not particularly dangerous, is not physically addictive, has no LD50 value, etc.

and that's a GOOD THING?

it's absurd.

7. Denver has been awake for several years.
Full MMJ and possession of up to an ounce is decriminalized, and nobody seems to mind at all. Most squares I've talked to don't even know about the decrim law. IMO that speaks volumes, Cannabis smokers are not a scourge on society.

Not perfect by any means, but it's a really good start and a great test case.

in actuality, it'll probably increase their profits. They be able to get it cheaper, but will still be selling it on the black market here.

24. I am seriously contemplating
turning my vegetable patch into a marijuana patch, after watching CNBC's "Marijuana, Inc." A guy standing in a back yard about the size of mine, in Mendicino County, claimed that his patch would produce $300,000 worth of crop. Not sure if that was wholesale, or street value.
