Appellate Court Rules Media Can Legally Lie.

By Mike Gaddy. Published Feb. 28, 2003
On February 14, a Florida Appeals court ruled there is absolutely nothing illegal about lying, concealing or distorting information by a major press organization. The court reversed the $425,000 jury verdict in favor of journalist Jane Akre who charged she was pressured by Fox Television management and lawyers to air what she knew and documented to be false information. The ruling basically declares it is technically not against any law, rule, or regulation to deliberately lie or distort the news on a television broadcast.

On August 18, 2000, a six-person jury was unanimous in its conclusion that Akre was indeed fired for threatening to report the station's pressure to broadcast what jurors decided was "a false, distorted, or slanted" story about the widespread use of growth hormone in dairy cows.

The court did not dispute the heart of Akre's claim, that Fox pressured her to broadcast a false story to protect the broadcaster from having to defend the truth in court, as well as suffer the ire of irate advertisers. Fox argued from the first, and failed on three separate occasions, in front of three different judges, to have the case tossed out on the grounds there is no hard, fast, and written rule against deliberate distortion of the news.

13. My understanding that this episode has damaged ACORN
has zip all to do with Fux News, dear. It has to do with actually paying attention. You really ought to give it a try. The Senate has voted overwhelmingly to defund ACORN's Housing division and the admin has booted ACORN from participating in the census. There's far more to come. And ACORN hasn't been handling this well from a PR perspective.

6. You really should spend more time on youtube
teh stoopid is everywhere in every organization - ACORn isn't unique - you can find cop brutality, morons xeroxing their ass on the company copier, airline pilots hot dogging in 200 ton airplanes, you name it. ACORN is being subjected to a right wing witch hunt.

there is usually a huge outcry and demand for reform. And I don't recall people on here making excuses for them.

8. You haven't met the cop apologists?
Any time I go into a thread about cop misbehavior (and by misbehavior, I mean getting tazey with 12 year old girls or 'accidentally' killing innocent people) I always find at least a half dozen apologists who insist that the cop did nothing wrong and that I couldn't possibly judge their actions unless I was a cop myself. Happens every time, for some, cops can do absolutely no wrong.

And as soon as I see people defending ACORN for killing innocents and tasing 12 year olds, then I'll think they suck as well.

26. Some people would view attempting to help set up
what the individual in question believed to be a child sex ring, would be a bad thing.

Some, but not all apparently.

28. I don't know anything of the sort now.
It seems that some, if not all of these supposed stings featured employees who were bullshitting with the plants on a larf. And before you say "but they already fired the employees", I'm very well aware of that, it was a PR nightmare and it needed to be done. And even if the employees willingly and knowingly participated, it reflects poorly on those individuals, not ACORN itself, so much. I need to see a lot more before I can make a conclusion either way. But jumping on board the fox bandwagon at this time is NOT the prudent thing to do. I'll take anything a "news" organization (that sued for its right to lie ) says with a whole mess of salt.

30. So you're going with the theory
that all four instances the ACORN workers were cooperating with the sting investigation to get themselves fired and cost their organization heavily?

I swear officer, I was just playing along, I could tell you wanted me to drive drunk, it was all a game, so we're cool right?

33. What a ridiculous logical argument you make there.
I never suggested there was a conspiracy. I just said that I'm not willing to take fox or its affiliates at face value after they actually sued for the right to sue. Are YOU willing to give them the benefit of the doubt here? And it's quite obvious that at least one of the people targeted by this sting was playing along as she spewed equally ridiculous things right back at them. She was fired regardless because this is for PR and nothing else. If she can be fired with no valid reason, it's no stretch to think that others could be as well. I never suggested ACORN being infallible, you had to throw that out there to try and bolster your extremely weak argument.

14. Well, in this case, the bad apples...
were giving advice about how to make money from child prostitution and hide it from the tax people. That's kind of a big deal, especially when it is being subsidized by federal funds. On top of that, ACORN is now trying to spin a story that the worker in California was just playing along because she knew it was such an outlandish scenario it could never be true.

ACORN is not going to come out of this looking good.

21. Hey, I am sure that ACORN has plenty of honest, sincere people working for them
However, given the scrunity place on the organization during the campaign last year, I would have thought that tightening up the ship was an obvious move. Those women should never have been hired. That one lady from the new video was downright SCARY! Talking about killing people?! WTF?!

Watch for more such attacks in the next four to eight years.
