Let's propose a bill allowing Congressmen to opt their districts out of The Census.
Ask Michelle Bachmann to co-sponsor it.

4. It would probably require a Constitutional amendment
as it is the Constitution that lays out the requirement for a census.

I think Bachmann's problem is that it won't be a surprise if Minnesota loses a House seat. If that happens, her district (CD 6) is the one that the odds say would disappear as it is the one that borders the most other districts. There has also been speculation that CD-5, which contains all of St. Paul and is a very blue district would be extended to include Stillwater - where Bachmann lives and where you may be more apt to find some DFLers in the 6th.

Bachmann is probably trying to save her job.

5. From Section 2 of the Constitution...
The actual Enumeration shall be made within three Years after the first Meeting of the Congress of the United States, and within every subsequent Term of ten Years, in such Manner as they shall by Law direct.

I might be possible to pass such a law, as I read the article in the Constitution that calls for it. Not that the right would allow such a law. They know very well what it would mean.

7. Sorry, sir, but the tenth amendment don't apply.

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

That power is an enumerated power delegated to the Legislative Branch, and is therefore denied the states. Should any state wish to not comply, they may call a Constitution Congress and dissolve the union. (Attacking Fort Sumter also seems to work.)

So put together a regiment or two of Gray clad solders and we can meet at Fort Sumter.
