My sense of it is that we have perhaps 150-170 votes to repeal in the House and at least 50, but nowhere near 60 in the Senate to kill a filibuster.

I think there should be a vote every year to repeal this odious law. I bet you that every year you could get a few more comers to support a repeal. Even if the votes are not within reach, I think that a floor vote is owed to the supporters of marriage equality.

Aside from the argument on behalf of this being a matter of civil rights and equality, which I fully endorse, one could also make a separate argument on behalf of states rights for the repeal of the law. Marriage is a benefit that is conferred only by the states. The federal government does not marry anybody, and therefore has no grounds to refuse to recognize a benefit that is conferred at the liberty of the states.

1. Dunno, but should have happened like yesterday. Love to see an actual filibuster of a repeal.
It'd be like Strom Thurmond filibustering to save segregation.

9. Rahm Emmanuel was asked about this at the Hate Crimes signing and he walked away
Rather than discuss it...

http://www.bilerico.com/2009/10/the_white_house.php

We talked with Barney Frank- surprise, he lives only a couple blocks from my house. I didn't want to get yelled at so I didn't ask about ENDA. Instead, I went on the Rahm Emmanuel, who was standing by himself. I shook his hand and said, So when are you going to stop with this one man one woman stuff?

What do you mean? he said.

I raised my eyebrows and said, You know what I mean, and it makes your candidate look like he's stuck in the 1990's. It' 2009. C'mon.

Let's get healthcare first, he said.

I said, I don't know if I can wait that long.

And off he scurried.
