Hey, I know--let's put everybody's individual rights up for a vote
in every state. Let's all vote on gun ownership, free speech, inter-racial marriage, privacy, religious freedom, the whole nine yards. And let's keep doing it until we get the most oppressive possible results!

Seriously, I thought it was a bunch of different people, religious fundamentalist freaks, not President Obama.

Nor is 'gun ownership' in those words. If 'maintain a militia' is the same as 'gun owership' then 'pursuit of happiness' would have to include domestic happiness as married people, don't you think?
Or we could just put Divorce and Remarriage up for a vote. No 'right to divorce' in the Constitution. I like that one.

That's the Declaration of Independence.

There are rights protected explicitly in the Bill of Rights (press, association, religion, keep and bear arms) then there are unenumerated rights (see ninth and tenth amendments.) The BoR isn't a "the people can" document, it's a "the government can't" document. Seems like semantics until you think about the unenumerated rights.

11. Equal protection
is in the 14th amendment, but we seem to feel it's fine to bring it up for a vote at the state level. So why not gun ownership and free speech?

13. How about iniatives that folks have to pull thier pants down
and prove their sex to a Justice of the Peace before they can get married. Maybe even submit to blood tests and psych evals to prove they are a man and a woman.
