Orly Taitz Just Filed A NEW Motion In Court, Cites Obama's "Homosexual Lover" As Witness
Obama birthplace lawyer lashes out at court
November 10th, 2009, 12:05 pm · 49 Comments · posted by Martin Wisckol, Politics reporter

Laguna Niguel attorney Orly Taitz has filed a fiery motion to revive her dismissed lawsuit challenging the legitimacy of Barack Obama’s presidency. The documents filed with federal District Judge David O. Carter’s Santa Ana court include allegations that a law clerk working for Carter previously worked for a law firm defending Obama, and that that clerk wrote most of Carter’s ruling dismissing Taitz’s suit.

That suit sought to prove that Obama was born in Kenya and so does not meet the qualifications to be president. Carter’s Oct. 29 ruling said that removal of a president is, by the authority of the Constitution, a matter for Congress, not the courts.

In his ruling, Carter repeatedly chastised Taitz. At one point, he complains that she had her followers contact the court in an effort to sway his opinion, and at another point, he says he’s received several affidavits from witnesses who say that Taitz asked them to lie to the court.

Taitz denied both points in her filing.

39. Now there's a "No Exit" combo that would be a fitting Hell for all three!
Three people are locked in a room together for eternity - that's J-P Sartre's "Huis Clos" scenario.
Every so often, when those who seem to be getting away high crimes and misdemeanors really get to me, I imagine which three I'd like to see together for eternity creating their own Hell. Sometimes it helps.

57. Somebody needs to go look up her immigration documents
One source I had said they had not been able to find them - or those of Orly's husband. Orly's story is that she traveled to Las Vegas to marry him after meeting him in Israel and going out twice. So there should be papers for the husband, a visa for Orly, and papers for her in the immigration files somewhere.

Different court from the one where she had to argue why she shouldn't get $10K in sanctions and after being even more disrespectful in that argument she was socked with $20K.

Carter will start the ball rolling at $10K since she accuses him of a felony in her motion to reconsider.

Larry Sinclair: Orly Taitz Told Me to Lie, Claim That Obama Had People Killed
Digg Tweet By David Weigel 9/16/09 5:32 PM

The affidavit that Obama foe Larry Sinclair claims to have filed in a California court, in which he accuses birther Orly Taitz of trying to get him to lie on the stand, is available right here. In it, Sinclair recounts being ushered into Taitz’s office and being told by her to “testify that three (3) member (sic) of Obama’s church were murder (sic).” Sinclair claims to have recoiled at this, at which point Taitz encouraged him to say it anyway ...

25. And Arnold Schwarzenegger may have guaranteed Taitz is not disbarred
Edited on Tue Nov-10-09 04:50 PM by WeDidIt
Seems the CA Bar (though not tax payer funded) must get a bill passed annually and signed by the governor in order to send invoices to its membership.

Seems the judges committee of the CA Bar gave a friend of the governor a "not qualified" rating since said friend had not been in a court room for over 20 years. This pissed off Mr. Governator and he vetoed the bill that allows the CA Bar to invoice its membership.

So the CA Bar may have no money to hold hearings to disbar Orly Taitz in 2010.

Gee, thanks Arnold.

41. Where did Taitz live before moving to the USA?
Has anyone done any research as to Taitz's previous countries of residence? Perhaps that may provide some clues as to her motivations. She may be crazy but she was able, at one point in her life, to pass the BAR exam in whatever state(s) she practices in. Maybe she's simply a "plant" (no pun intended) to provide a mild level of annoyance, disinformation, distraction and, perhaps even sway some logic and intellectually challenged folks over to the teabagger/birther/death-panelist's tinfoil hat side. Just wonderin'........

Edited on Tue Nov-10-09 05:14 PM by WeDidIt
She emigrated to Israel from Moldavia where she met the future Mr. Taitz who moved back to the US after marrying her.

Edited to add: She attended an online law school that has no accreditation (Taft). California is the only state in the union that allows graduates from law schools that are not accredited to sit the bar exam.

Basically, she attended a three year long Barbri, then took the bar.

58. Officially she was born in Moldava, moved to Israel, met her husband
And moved to the US.

"She said she was raised in Kishinev (or Chisinau, now the capital of Moldova), but was granted permission in 1981 to leave and join an uncle who had moved to Israel; once there, she learned Hebrew and earned a degree in dentistry from Hebrew University. Her chance to get to America—a place her father had always told her was full of opportunities to reap the rewards of hard work—came in 1987, when one of her mother’s fellow schoolteachers offered to set her up with a software engineer named Yosef Taitz who was visiting from California; on their second date, she said, he proposed, and she accepted. (They got married in Las Vegas.)" http://www.tabletmag.com/news-and-politics/11908/in-doubt%E2%80%99s-shadow/

62. I wonder if Orly can say "Rule 11"
Motion for Reconsideration ...
... Your Honor hired as .. law clerk .. Siddharth Velamoor, who previously worked for Perkins Coie, a law firm representing the defendant in the above case ... Mr. Velamoor will surely claim that he didn’t work on Obama case before ... and ... the undersigned counsel ... is also the only one to bring forward evidence from licensed investigators showing Mr. Obama committing multiple felonies, for which he should be serving lengthy prison term.
... Larry Sinclair was asked to authenticate an affidavit he submitted to the Chicago police regarding the homicide of Mr. Donald Young. In the affidavit submitted to the Chicago police and in his book recently published, Mr. Sinclair has stated that Mr. Donald Young has contacted him repeatedly and stated that he had a homosexual relationship with Mr. Barack Obama and that Mr. Young was found dead with multiple gunshot wounds December 23, 2007 at the onset of 2008 Democratic primary elections ...
Lucas Smith was asked to authenticate Mr. Barack Obama’s birth certificate from Kenya, which he previously tried to sell on e-bay ...
... The undersigned has submitted .. The Law of Nations by Emer De Vattel, .. arguing that .. he had British Citizenship .. based on the citizenship of his father. Later he acquired Kenyan and Indonesian citizenship, therefore he did not qualify as a Natural Born Citizen, as from birth and until now he had allegiance to other Nations.

Motion for Reconsideration
My name is Orly Taitz. I am .. of sound mind ...
... Mr. Sinclair stated that Mr. Donald Young contacted him repeatedly and told Mr. Sinclair that he had a lengthy homosexual relationship with Mr. Obama ... Mr. Young was found dead, shot in the back of his head at the onset of the Democratic primaries for 2008 presidential election ...
I asked Mr. Lucas Smith to authenticate Kenyan birth certificate for Mr. Barack Hussein Obama, which he previously tried to sell to the highest bidder on E-bay ...
As of now I am the only attorney with the courage, integrity and strength of character to ... submit to court information from two licensed investigators, showing that Mr. Obama has used 39 different social security numbers ...
I am bringing forward evidence showing that Mr. Barack Hussein Obama, sitting president, is guilty of multiple felonies, for which he might need to spend the rest of his life in prison.
I believe that I am being targeted in an effort to silence me ...

I'm not a lawyer, but these filings seem to me to show a stunning incompetence at law, beyond the mere recital of allegation after allegation as fact. "Obama inherited British citizenship from his father" assumes British or international law governs the US definition of US citizenship. Her complaint she was denied discovery for her RICO case assumes discovery should be allowed without some rational basis for it. She misunderstands judicial reluctance to interfere with military orders as a comment on the relation between military law and her ineligibility claims. She sees only half of the significance of Sinclair's claim that she asked him to lie: if Sinclair makes the claim truthfully, she has suborned perjury; but if Sinclair makes the claim corruptly, he has destroyed all his own credibility as a witness, and she should not cite him further -- but cite him further she does

66. Makes me wonder if the judge will finally charge her for barratry
http://www.yourdictionary.com/law/barratry

The persistent incitement or initiation of groundless lawsuits and quarrels. Was a crime under the common law and is a statutory crime in most states.

85. No kidding
I've long thought this was just a big fundraising scam on her part. She's constantly begging for donations. She claims her foundation is a non-profit but there's no evidence of that. The Birthers are all suing each other over funds raised. I'd love to see some financial statements for her "foundation" - what legal mechanism would pry those loose?

87. If she claims it as a non profit
DUers should send her some petty cash, and get reciepts. We should then sue her for falsely proclaiming her non-profit status, and force her to open the books.

75. It's truly amazing.
Of ALL the things anyone could deride Obama for, they always select the most nonessential, miss-the-target, erroneous ones.

They are grasping at straws because they're too ****ing stupid to think critically.

Of course, the BIG question (like the elephant in the room) is, "Where the **** were you from 2000 to 2008??"

I guess possible gay liaisons trump the usurpation of America's rights and freedom.

I wish I could think of a really good Napoleon Dynamite expletive right now.

82. The term "vexatious litigant" comes to mind
Orly files a lawsuit claiming the president wasn't born in the US. The court throws it out. She does it again, they do it again. Over and over. Eventually some kindly judge is going to tell her, "he's a natural born citizen and you can't file any more lawsuits."

But how long will it take?

83. It gets worse - her affair with Charles Edward Lincoln III, impending divorce...
Edited on Sun Nov-15-09 11:23 AM by Stephanie
Read Lincoln's Affidavit at pg. 18 here - in regard to one of his real estate scam suits.

http://www.scribd.com/doc/22515658/RIVERNIDER-v-U-S-BANK-20-RESPONSE-to-17-Order-to-Show-Cause-by-Charles-Edward-Lincoln-III-Marsha-G-Rivernider-Robert-H-Rivernider-Attachment

For the past five months, I worked closely with Dr. Orly Taitz, Esquire, and in fact formed a close-bond and intimate personal relationship of trust and special confidence with her; this relationship did not end well.

***

Dr. Taitz informed me that her husband, Yosef Taitz had threatened/instructed her that if she continued to work with me, and especially if she signed any contracts with me, that he would require her to sign away all of her rights in the family property and estate, a much harsher result that he could have achieved if she (Dr. Orly Taitz) had sought an ordinary judicial divorce from Mr. Yosef Taitz or if he had sought a divorce from her (especially in a community property state).
