The Best comment of the SOTU: Obama looked straight at SCJ Roberts
and said that the SCOTUS has overturned 100 years of accepted law, with their decision on campaign finance last week.

He then asks for support to repair the damage from that decision.

Former USSC Justice Sandra Day O'Connor has been speaking out about the effect on judgeships, which in most states remain ELECTED positions. This is absolutely criminal. Not only will our legislative and executive branches be bastardized in terms of elections, but so, too our judicial system. She, to her credit, is very very angry about this decision, which actually overturns a previous opinion she wrote.

They don't count, in the sense that his no vote did nothing to stand in the way of their confirmation. The only way for the Democrats to stop Roberts or Alito was to filibuster. I'm not singling out the President, because the rest of the Democrats in the Senate folded like a lawn chair and peed their collective pants at the threat of "nuclear option" and the vaunted "Gang of 14", but the fact remains, the only way to have tried to stop Roberts and Alito was to filibuster and then Senator Obama didn't get anywhere near it. By the time it got to the floor the outcome was certain. The no vote was at best symbolic.
