At that time of night they're so cold they barely have the energy to move or react to things, which is how the photographer could get shots like that set up so easily. If he'd actually startled one of them they'd probably groggily fall over to one side or something similarly ineffective. By the time they've warmed up enough that their brains are on all cylinders, they'll have mostly dried off.
