Federal prosecutors in Detroit late today asked U.S. District Judge Victoria Roberts to delay the release of nine members of a Lenawee County Christian militia group who were expected to be released on bond Tuesday.
U.S. Attorney Barbara McQuade said in the filing that prosecutors were in the process of asking the U.S. Solicitor General to appeal Roberts’ 36-page ruling today that federal prosecutors failed to show the defendants were a danger to the community or a flight risk.
McQuade said the defendants had threatened to kill police officers and in light of today’s fatal police shooting in Detroit: “Given the defendants obvious animosity towards police officers and their previous discussion regarding their intent to bomb a police funeral, this fact presents additional reasonable basis for the requested stay.”
Defense lawyers were quick to respond.
“That’s outrageous — just outrageous,” said William Swor, who represents David Stone, 45 of Clayton, the alleged leader of the Hutaree militia group.
