Far-Right Group AFA Demands To Know Kagan’s Sexuality, Since ‘No Lesbian Is Qualified’ To Sit On SCOTUS

Today, President Obama nominated Solicitor General Elena Kagan for the Supreme Court. Since she happens to be an unmarried woman who has not publicly commented on her sexuality and supports LGBT rights, many on the right are making assumptions about her personal life — and therefore her fitness to serve as a justice. Last month, CBS News published an online column by GOP operative Ben Domenech, which called Kagan the “first openly gay justice.” The White House quickly responded, demanding that CBS pull down the post and saying that the site was “applying old stereotypes to single women with successful careers.”

The right wing has been hammering Kagan over the fact that while she was dean, Harvard Law School “refused to help the nation’s military recruit its students, because the armed services discriminated against openly gay soldiers.” Conservatives have been using this episode to unjustly portray her as being anti-military and to add fuel to the speculation over whether or not she is a lesbian. In a blog post for the far-right American Family Association (AFA) today, Bryan Fischer comes right out and says that the media should pointedly ask Kagan, “Are you a lesbian?” And if she is, according to AFA, she shouldn’t serve on the court:



Americans For Truth — a group “devoted exclusively to exposing and countering the homosexual activist agenda” — also put out a statement saying that Kagan needs to answer, “Are (or were) you a practicing homosexual or do you consider yourself homosexual (gay)?” Last month, Focus on the Family also said that it would not be open to a gay Supreme Court justice.

The right-wing assumption that if she is a lesbian, she will have a conflict-of-interest and be personally biased in certain areas is similar to the criticisms the right had against Sonia Sotomayor and the fact that she is a Latina. Maybe Chief Justice Roberts. I have always thought he was a closet case. I wouldn't care one way or the other, except for the hypocrisy.

I know a few closet cases in my community. They feel they have to stay in the closet in order to do the work or community service they do. They feel they would be shunned if they came out. I don't know. It is a personal choice, as long as they are not loudly anti-gay.

Right now I feel a LOT of sympathy for Ms. Kagan. All I know is that she's an unmarried woman and that people are spreading rumors about her on that basis. If she's straight does it mean she's not complete without a husband? If she's gay does that mean that her current partner is someone she has made a lifelong committment to? Maybe, maybe not.

Would a man be subjected to this scrutiny? Would a man be expected to produce his current girlfriend to the public's perusal? Or would it be just fine for him to play the field, or even have a long term relationship with someone he wasn't sure he wanted to marry?

My head is spinning on this. That's why I'm just gonna let both sides jabber about her to their hearts' content. And I'll just listen to her answers at the confirmation hearings.

I don't give a shit about anything except her ability to protect the constitution and be fair.

But really, no man would be subject to this--he'd just be a confirmed most-eligible bachelor.

There were rumors about one Justice but I don't recall him being attacked by ANY side because of orientation or closeted state. But this unmarried woman is enduring both and there certainly won't be anybody proclaiming her to be a catch since she's not 23 and on the cover of Sports Illustrated.

I have no idea of Elena Kagan's sexuality. She could even be asexual--someone who doesn't want to have sex at all. But compared to some of the weird sexual shit that goes on in the Republican Party, a nice sane lesbian would be a breath of fresh air.

I confess that I haven't done much research on Kagan. One thing I do know is that I absolutely detest AFA and Focus on the Family. I tend to like people and ideas they hate.
