Proposal Would Delay Hearings in Terror Cases
By CHARLIE SAVAGE

WASHINGTON – President Obama’s legal advisers are considering asking Congress to allow the government to detain terrorism suspects longer after their arrests before presenting them to a judge for an initial hearing, according to administration officials familiar with the discussions.

If approved, the idea to delay hearings would be attached to broader legislation to allow interrogators to withhold Miranda warnings from terrorism suspects for lengthy periods, as Attorney General Eric H. Holder Jr. proposed last week.

The goal of both measures would be to open a window of time after an arrest in which interrogators could question a terrorism suspect without an interruption that might cause the prisoner to stop talking. It is not clear how long of a delay the administration is considering seeking.

3. To be fair
As one who can be fairly critical of this president, we do have to be a tad fair here. Obama gets criticized for not having "done things yet", and merely proposing them or "committing" to them. So it would seem a tad premature to start "blaming" him for something he hasn't even actually proposed. Staff is working on the rules surrounding these interrogations. They are working on them because they don't like the rules left behind by the Bush Administration.

I'll admit, based upon past experience on this topic, I'm not encouraged by what he may dream up. But the flip side is that these kinds of stories are "leaked" in an attempt to influence the development of the strategy.

The intent here is to try to conform to the structure of the law (how many hours prior to being seen by a judge, what and how long can they ask him questions prior to Mirandizing him, etc.) and yet modify the actual numbers. The numbers that the government uses aren't so much a matter of the Supreme Court decisions as they were laws and guidelines that were drawn up after the fact. If Obama wants to increase the time from 6 to 8 hours, I'm not going to lose sleep. If they want to give the FBI 24 hours to find out if there is another attack coming, I can be convinced. If they just want to clear a quicker path to their new Gitmo, I'll be pissed.

5. If it were unfair, I'd expect a denial would already have been issued.
I think they're considering something very much as described, and if so, it stinks.

10. Not Obama's style
He tries to avoid the "no I didn't" kinda release. He doesn't want to fight out these things in public. I'm afraid too, that it is close to what is going to be produced. There's also the possibility that it is a "trial balloon", which would really suck.

13. IMO, once one takes the bigger view that our system of governance is 100% gamed, it all makes sense
All of the confusion people have as to 'Why doesn't OUR party do this or that?' suddenly fits a pattern that yields similar results every time

I suspect many oppose any criticism of the two party's rule b/c the notion that We The People haven't any actual, substantive representation is simply too much to bear.

I find the exact same thing in dealing with being homeless. People can't believe that "help agencies" aren't helpful....that there truly isn't housing available. Its too painful to even contemplate that this country is purposefully creating homelessness. (And that includes the Dems).

So, yes... I think it is too painful, and people would then have to actually DEMAND and WORK FOR "change".
