Judge files notice of claim against Arpaio, other officials
Edited on Fri May-21-10 11:21 PM by Catshrink
Uh-oh, more legal trouble for Sheriff Joe. You'd think the voters would realize the millions of money Joe wastes on his endless vendettas.

Judge files notice of claim against Arpaio, other officials

An attorney representing Maricopa County Superior Court Judge Gary Donahoe filed a notice of claim against county officials Friday morning.

The claim alleges Sheriff Joe Arpaio and former County Attorney Andrew Thomas and others abused their power when they named him in a federal racketeering lawsuit last year. The claim names Arpaio, Thomas, Chief Deputy David Hendershott, and Deputy County Attorney Lisa Aubuchon.

<snip>

Thomas had pursued a criminal case against Donahoe alleging bribery, obstructing justice and hindering prosecution. Thomas and Arpaio last December filed a federal racketeering suit that named Donahoe. In it, they claimed judges and county officials had conspired to take resources from their offices and hindered prosecutions.

But another Superior Court judge cited the suit as creating a conflict of interest for several other prosecutions by Thomas. As a result, the judge threw out a criminal case against Supervisor Mary Rose Wilcox, prompting Thomas to then dismiss cases against Supervisor Don Stapley and Donahoe.

The notice of claim accuses the Sheriff and County Attorney of trying to exact revenge against Donahoe for rulings adverse to them.

"(Their) evil and vindictive personal attack on Judge Donahoe was designed to punish him for adverse rulings he issued, to prevent him from making future rulings, and to terrorize other members of the bench who might dare to rule against them," wrote Donahoe's attorney Michael Manning. "That abuse of power and position and this brazen attack on our community's judiciary is an unprecedented convulsion of their demagoguery."

8. Notice of claim is a civil procedure prior to filling suit against the state
it can cite criminal behavior, but is not criminal procedure.
