'He got the bag over my head:' Witness in Burge trial

'Something special' inflicted by Burge underlings, man testifies

June 11, 2010

BY RUMMANA HUSSAIN Criminal Courts Reporter

He said he first had a nickel-plated gun shoved in his mouth.

Gregory Banks then said he was hit with a flashlight and repeatedly kicked.

And when Banks continued to deny he knew anything about the 1983 murder of Leon Barkan, one of former Chicago Police Cmdr. Jon Burge's underlings introduced Banks to a brutal interrogation technique he said was solely reserved for African-American suspects, Banks testified Thursday.

"We have something special for n------," Banks said, recalling what Detective Peter Dignan told him while holding a beige plastic bag at Area 2 nearly 30 years ago.

Banks said Dignan continued to smother him by placing the bag on his head for a minute or two as Sgt. John Byrne and Detective Charles Grunhard stood by. Byrne had put the gun in Banks' mouth and hit him with the flashlight, Banks testified.

Banks, 46, said he couldn't breathe with the bag over his head, but he maintained his innocence. However, when Dignan placed the bag on his head a second time, the then-20-year-old was ready to confess to "do whatever he could to sustain" his life, he said.

After doing an investigation here in Illinois we discovered that 13 out of 25 men who were on death row were factually innocent. Imagine spending one day on death row for a crime you didn't commit.
