Family Law Judge Challenges Father's Use Of Drug

SACRAMENTO, Calif. -- One Sacramento County family law judge is challenging a father’s right to use medical marijuana.

Judge James Mize recently ruled that Troy Kreb can not use medical marijuana in any form 24 hours prior to, during and 24 hours after visitation with his 8-year-old daughter.

“I’m disgusted. I’m very disappointed in the system. I think the judge is playing doctor,” Kreb said.

Kreb uses marijuana to treat the pain caused by his scoliosis because he said it has more benefits and less harm to his body.

Kreb’s ex-wife Marcie Voorhees said Kreb’s choice painkiller leaves him unfit to care for their daughter and asked Judge Mize to prevent Kreb from using the drug.

1. Unless there are going to be similar laws enacted for all prescription pain meds that cause
side effects that can impact parenting, this is ridiculous.

Then again, maybe there should be laws for all of them, because I know my mother wasn't fit to be taking care of me and my siblings as children when she was on them.

3. The article doesn't specify that he's been prescribed medication.
...I would guess that would be the turning point on a hopefully successful appeal.

For example, if a person has a history of abusing prescription painkillers yet has never been prescribed them by a doctor?

5. I wonder if this same judge
would have ruled differently if the father was taking a "pill" like demoral or an opiate to control the pain? The pain killers I've used in the past left me loopy and very lathargic which I see as less responsible with a child. I've never felt out of it with weed.
