MSNBC reporting Warren Jeffs to get new trial.
The jury instructions about "consent" were in error.

I wonder if we'll notice any new hair or dress fashions as the circus once again marches to downtown.

8. For shame yourself ! We are responsible for the health and
safety of all prisoners we have in custody. There is no law stating that any crime in the US is punishable by random prison rape. The fact that anyone is raped in prison is a crime that we all are responsible for.

Human rights are meaningless here on so many levels. We can't even count on the courts to protect children from organized predators. Shameful.

Unless you want mob justice--which is what some people on DU seem to favor when the accused is someone they disapprove of--then there needs to be a system of checks and balances. Yell at the judge for fucking up the instructions, if you need to be mad at someone.

are legally CHILDREN.

There can be no consent with CHILDREN.

12. It made me angry because the abuse of women and children
is very often condoned in this society and this smacks of another chance for that to happen.

11. Not sure I understand why he gets a new trial
Can someone more legally minded than me explain what the issue was with the first trial?

The biggest worry here is that Jeffs will run. He will. Believe it. Last time a warrant was issued for him it took several years to locate him.

13. it think the judge messed up the jury instructions
in which case he, like any defendant, is entitled to a new trial since he didnt get a fair one in the first place

dollar to a doughnut says he will be convicted again

i cant beleive people are bitching about the fact we have due process in this country

15. I agree, if something was wrong in the first trial he deserves a re-trial
My level of disgust for this man not withstanding, if there was a clear reason for calling for a new trial, I'm fine with that. That being said, this is Utah and whether or not he's getting undue sympathy is a concern. That, and the fact that as soon as he touches free ground, he's going to bolt.

but the system has ways of dealing with flight risks

electronic monitoring etc.
