C-Span is running an alert saying the Senate has confirmed Elena Kagan by a 63-37 vote.

By a vote of 63-37 the Senate today approved U.S. Solicitor General Elena Kagan as the 112th Justice of the Supreme Court. With the confirmation process complete, Kagan will next go to the Supreme Court to take the Constitutional Oath and the Judicial Oath, both to be administered by Chief Justice John Roberts.

Nebraska Democratic Senator Ben Nelson was the only member of his party who opposed Kagan in the final vote. Five Republican Senators joined the Democratic majority to support the nominee: Susan Collins (ME), Lindsey Graham (SC), Richard Lugar (IN), Olympia Snowe (ME) and Judd Gregg (NH).

Kagan will replace retiring Justice John Paul Stevens and become the fourth female Justice in the Supreme Court's history. For the first time in its history, he nine-member court will now have three sitting female justices.

Just moments ago, the Senate confirmed Elena Kagan to be the next justice on the United States Supreme Court.

This is a day we'll remember -- the day the fourth woman in our nation's history was approved to serve on the Court. And when she is sworn in, she'll join Justices Ginsburg and Sotomayor -- marking the first time three woman have served together on the highest court in the land. Throughout this process, we saw why President Obama has called her "one of the best legal minds of her generation."

Today, we celebrate that the next stop in her trailblazing career will be as an associate justice on the Supreme Court.

15. But did you hear what Franken said
that there was a proposal to vote again on her confirmation. Since she won the nomination how did the REPUBLICAN who made the request take it seriously.
