Judge rejects Obama adminstration's request for stay of injunction that bans DADT discrimination


BREAKING NEWS: Judge Phillips keeps DADT injunction in place, but DOJ plans to appeal

RIVERSIDE -- U.S. District Court Judge Virginia A. Phillips this afternoon rejected the Department of Justice’s request for a stay of her worldwide injunction that bars enforcement of the military’s discriminatory “Don’t Ask, Don’t Tell” policy.

DOJ attorneys vowed to appeal the case to the Ninth U.S. Circuit Court of Appeals in San Francisco.

Judge Phillips scoffed at DOJ attorneys, who submitted flimsy evidence about why the suspension of the DADT policy was detrimental to the military. She also said the request for a stay was untimely.

Among the “evidence” the DOJ presented was a recent Rolling Stone interview with President Barack Obama, which Judge Phillips derided as “hearsay.”

No DADT for nearly a week and the military has survived. They are running out of excuses to end this discrimination.

9. I think Obama wants it to be repealed by congress
and not DADTs constitutionality rejected, as if the ruling holds through to the SCOTUS, it would effectively make sexual orientation as a protected class and make it illegal to discriminate against gays in marriage, and all other adult contracts.

10. I'm Wondering If the DOJ Made A Half Hearted Attempt In This Appeal......
knowing that they would be criticized if they didn't follow through on the appeal - so they just put up a weak argument. The way the other side has been jumping on Obama for every move he or his administration makes - this gave them the cover of doing what they had to do as the DOJ - maybe with knowing that Judge Phillips would react the way she did.

23. Yes, and every day that passes with DADT no longer a policy
and the military surviving, demolishes the reasons given for the appeal. That the military 'needs time to adjust to this new policy'. Apparently they have adjusted just fine so far.
