What students write in their law reviews doesn't always have a long shelf life. But a nominee for a federal appeals court in Washington happened to pick a subject that is still timely a decade and a half later: the rationing of healthcare services.
Caitlin Halligan was fresh out of Georgetown University Law Center in 1995 when her law school “note” was published. She chose to write about the state of Oregon’s attempt to limit spending on healthcare — specifically, what it means to have government-appointed experts making such decisions, versus allowing greater public input...
Halligan’s interest, though, was more specific — whether the general public should have a role in putting together such a list, and if so, what that role should look like. Concluding that the public should, she writes that
