Barney Frank: If 'DADT' Repeal Fails to Pass, Obama Will Lose Any Claim He Has to Defend it in Court
I completely agree. If the Senate fails to repeal DADT in the lame duck session of Congress, we'll have to pursue repeal through the courts. It certainly isn't going to happen in the next Congress.


Rep. Barney Frank (D-MA) appeared last night on The Last Word with Lawrence O'Donnell to discuss the DREAM Act's chances for passage (the votes are there) and 'DADT' repeal, which he called objections to "outrageous".

Said Frank: "If the House has voted by majority to repeal it, the President thinks it should be repealed, the Senate majority is for repealing, the only thing that saves it is this abusive filibuster, then I think any claim that he has to defend it in court disapears. It has no more, any moral force, let the people who filibustered try to defend it in court."

1. I agree with letting the filibustering Senators defending it in court.
Obama needs to formally appeal, but they should say in the appeal that they believe it is unconstitutional and let the Republicans defend it if they want to. That's what the Clinton administration did in a similar situation.

2. Frank has that right. If the DADT repeal effort fails, Obama should withdraw the notice of appeal.

He's going to sell out another key part of his base for some more magic bipartisan beans.

Frankly, given his statements and actions, I'm starting to wonder if Obama isn't homophobic himself. Time after time when he has been presented with an opportunity to end DADT, he has instead put himself and his administration in opposition to ending DADT. He has gone out of his way to elevate homophobic pastors and politicians before the country. And he has stated that he is opposed to repealing DOMA and gay marriage in general. He is saying one thing, but his actions are speaking louder than words.

5. Unfortunately, with so many conservative judges on the bench,
I don't exactly like the odds, if that's how it's settled.

Remember how they dealt with Hardwick.
