Glenn Greenwald: Obama close to reversing Holder on civilian trials
One of the very few commendable steps taken by the Obama administration toward reversing the Bush/Cheney Constitution/Terrorism template was the DOJ's decision to try the five accused 9/11 defendants in a civilian court (just as the rest of the civilized world does with Terrorists). But ever since that was announced, Obama officials have been clearly signaling that they intend to reverse that decision in response to the GOP's political attacks (while Rahm Emanuel has been busy making clear he disagreed with Holder's choice), and a new story in The Washington Post this morning provides the clearest evidence yet that this will happen. The article reports that "President Obama's advisers are nearing a recommendation that Khalid Sheik Mohammed, the self-proclaimed mastermind of the Sept. 11, 2001, attacks, be prosecuted in a military tribunal . . . a step that would reverse Attorney General Eric H. Holder Jr.'s plan to try him in civilian court." This reversal will be due to "demands, mainly from Republicans, that Mohammed and his accused co-conspirators remain under military jurisdiction."

2. Same place CNN got it from; Republicans deciding this is how you do it.......
Why you think the media's not stressing that Obama ain't said shit yet
about anything?...and yet they are reporting the story like he has?

Watch Gergen on CNN spitting his little hyperbole out.

It's like, they are afraid that the President might pass his healthcare reform,
and are desperately looking for something to smear him with.

Can't have his poll numbers rising and folks supporting health care!
Not now!

Of course, many Liberals play dupes, and act like Obama announced this.
Just what the media ordered!

The media is the master,
and some here are their servants.

Easy as that. Media yields big power,
and knows how to lead via the nostrils.

4. Glenn mentions leaks from the White House:
Edited on Sat Mar-06-10 02:18 AM by EFerrari
"I obviously don't know whether this will in fact happen, but because these signals have come both from Eric Holder on the record and what are clearly coordinated, authorized anonymous White House "leaks," it seems quite likely. Without assuming that this is a fait accompli, I want to make several points about what it would mean if Obama does reverse Holder's decision and puts the five 9/11 defendants before a military commission:"

5. We've known for quite some time now that Rahm believes in the military commision for the defendants.
So he has been advised from some of his advisors to go that route already. So I still havent really seen anything to back up Obama being close to a reversal.

6. ACLU put out a press released in response to the WaHo article
objecting pretty fiercely. Has the WH answered it?

8. Well, we know the party of No is making everything as difficult as possible.
It wouldn't surprise me if the WH occasionally puts out leaks to fake them out and mess up their calculations. And it wouldn't surprise me if Obama went with Rahm or whoever on this, either. So I have no clue myself.

The fact is, the conviction record is much better in civilian trials so as usual, the Republicans want this to happen the wrong, worse way.
