3. The White House must have told Pete Williams because he is who reported it.
I think they pick (and rotate) what reporters they leak big news to - Pete Williams is the NBC Legal Correspondent.

4. We've been expecting a leak to come Sun night since Friday morning..
..... as reported by Mike Allen.

The West Wing may leak the pick to AP’s Ben Feller on the later side Sunday, then confirm it for others for morning editions.

Before Pres. Obama decided to even run.

Elena Kagan To Be Tapped as Next Supreme Court Justice

President Barack Obama will name Elena Kagan to replace retiring Justice John Paul Stevens on the U.S. Supreme Court, Politics Daily has learned. Kagan, 50, is currently the solicitor general of the United States and is the former dean of Harvard Law School. If confirmed, she would be the fourth woman to serve on the high court, and the third woman on the current court.
