18. Yes, and someone who came from that same state,
not a carpetbagger from the northeast.

I don't feel represented by this court as a Michigan native and the holder of a state U degree.

I'm sure that there are some southerners and westerners who think the same way.

Somedays I'll even settle for someone who lives and works west of the Hudson. There are other law schools other than the Ivies - I hear U. of Chicago has one :)

Someone graduating near the top of his or her class at Big State U is usually pretty sharp cookie, too.

And for private, there's Stanford.

This court is looks a little claustrophobic.

35. I'm surprised UMich the U or law school is not represented. It has a very high profile here
in DC. Very high.

Oddly enough, it's the UChicago Law School that gave us the conservative creeps that impeached Clinton.

40. U-Michigan is very good, if I don't say so myself.
I did my undergrad there and we are taking over D.C.

It also has a much more progressive reputation than U-Chicago.

But some folks have a very negative view of state schools, and the Ivy League clique is very, very strong.

46. I've run head-first into the Ivy League wall several times...
my best buddy has a phd from UM. My neighbor across the hall does too.

My dad almost went there but USNA was free, so he didn't.

UMich folks are taking over DC, I guess they just haven't gotten to the court yet.

It's funny, I'm in Soviet/Russian studies, and the conference is ALWAYS the weekend of the OSU-UM game. It's amazing how the panels empty out and the bars fill!

47. We'll get to the court eventually.
U-M and OSU alums are very loyal, especially U-M. I remember the days of Bo vs. Woody, and I still love to cremate Ohio state. Of course, back then, it was, "Save fuel, burn Woody."

We all loved Ann Arbor and have very, very good memories.

It was a place with excellent academics but down to earth people.

I don't know what it is with the Ivies. They look down on everyone except maybe Stanford, Williams, Amherst and Swarthmore. Most of them are lots of sizzle, but less steak.

now has 1/3 of its membership from one fucking city.

Yeah, that's logical.

There are 9 positions on the Supreme Court. There are 9 federal court districts. The answer is obvious - One justice from each district, and when that justice retires or dies, they are replaced by another from that district.

Given the makeup of these 9 districts, it would still be ridiculously biased towards the East Coast, but at least not to one city.

Yeah, she was really from Virginia, but at least she's more recently from Stanford. Technically, not a West Coast native, but a step in the correct direction.

Hey, you know what, the majority of the U.S. Presidents have come from the New England area. I think that's unfair! We should have EVERY state have a U.S. President. So from now on, the next U.S. President must come from Idaho or Montana! Is that logical?

16. Actually, in our lifetime, most of the Presidents have allegedly come from the South.
And far too much Congressional power seems to end up in their hands as well.

I don't think ANY one region should dominate any branch of government.

As I said before, when it comes to the Supreme Court, the answer is simple enough. You have 9 federal circuits and 9 positions on the bench. One justice from each.

Now that may well mean that your Repuke president would appoint someone from Idaho, and the Democratic president would nominate someone from Seattle or San Francisco, but that's no different than the existing political nature of the appointments. At least the entire country could claim to be represented by the court.

19. Actually, there are 12 circuits if you include the D.C.-based Federal Ciruit.
The old 5th circuit split into the 5th (in the west, like Texas) and the East (like Georgia).

The old 9th split, too. Many of the mountain states are now in the 10th, and the 9th sticks to the coast.

20. Well, the idea of expanding the Supreme Court has been brought up in the past, for that matter.
I wouldn't be opposed to that, if I thought Obama might actually name some LIBERALS.

I do think the court should be more representative of the entire country though, in every way possible. And 1/3 of the members coming from one city, or the entire body coming from just two religious faiths, or all of them being from Ivy League schools, just does not accomplish that.

21. I agree with your diversity points.
It doesn't feel like my court, that's for sure.

And yes, ideas to expand the court have been tried. Our second President Roosevelt had a bad experience with that, although he survived politically and got the decisions he wanted generally.

And that's a point on which I harped to get some waverers to vote for Obama.

Nonetheless, I think that she may be further to the right on civil liberties and executive power than I am.

I would've gone with Diane Wood (sp).

34. Yeah, it's a tough call. But being on The Court changes folks and let's hope
that the greater freedom will tug her to the left a bit.

It certainly happened with Souter.

I know a guy who was one of McCain's classmates at the Naval Academy. He completely agreed with me that McCain had the absolute wrong temperament for the presidency and voted for Obama.

You must admit, that seems odd. A real lack of diversity there. There shouldn't be a religious test, I'm just pointing out that a group that represents 55% of Americans will not be represented (if Kagan is confirmed), but 3% of the country (Jews) would have 3 of the 9 seats. Catholics would have 6 seats. Interesting at the least.

Are we only interested in diversity as long as minorities are the ones unrepresented?

3% of the U.S. population ---- 3 seats out of 9
55% of the U.S. population ---- 0 seats out of 9
