Realistically, what will happen if Kagan fails to be confirmed?
I think we all should know the answer to that.

Obama would be forced to nominate somebody further to the right.

You know it.

I know it.

The GOP knows it.

That's why they tried to find ANYTHING to justify going after Sotamayor. It's why they'll try ANYTHING to take down Kagan.

They're fortunate that they have many allies on the Left who are helping them do this.

I tend to believe almost nobody knows anything much about this nominee's stances on most issues, including those she socializes with.

There are some very qualified folks that are much more know quantities but wingers would cry and pout. Kagan is punting and punting on 2nd down since the wingers are going to cry, pout, and try to drag this woman through mud of their own creation.

Of course it seems you somehow view Justice Kennedy as a moderate so our vantage points are wildly different. Justice Kennedy is one of the 10-15 most conservative justices to ever serve on the high court. He is the swing vote, not a middle ground or a moderate. Sometimes he figures the loony goons have gone a bridge too far but that ain't moderation but a sign of fading sanity.

She will be more or less liberal than any other potential candidate you could name on specific issues.

Overall, everybody on the list of prospective nominees was about equally liberal, the degrees differing only on specific issues.

That the far left is screaming will do more to help her confirmation process, though. The fringe on the left does serve its purpose...
