Grassley Asks Kagan: Didn't God Give Us The Right To Bear Arms? (VIDEO)

Usually, in a confirmation hearing for a Supreme Court nominee, the discussion of the Second Amendment comes down to a debate over whether the amendment guarantees an individual or collective the right to bear arms. One might think the matter was settled in Congress since Supreme Court rulings in Heller and McDonald leave the individual right to bear arms, as Elena Kagan said earlier today, "settled law." However, having a settled constitutional question left Sen. Charles Grassley (R-IA) with an opening to question whether the right to bear arms come from more than just the constitution. He wanted to know, in fact, whether it came straight from God.

During his questioning of Kagan, Grassley asked her not just about her opinion of Heller, McDonald or stare decisis, but about whether the right to bear arms predates the constitution Kagan is seeking to interpret on the court. He wasn't talking about the Magna Carta, or the Hammurabic Code, however: he wanted to know whether the right to carry man-made weapons actually came from a higher power. Kagan, for her part, didn't want to get into litigating whether a higher power gave us rights before we enshrined them in the document she'll be asked to interpret.

Seriously, how the hell is anything a right in the United States unless it is in the Constitution? How can anyone say a right came before that?

3. well ..... THAT part is not inaccurate....
.... the whole point of the Declaration of Independence, as Chuck correctly points out, was offered on the premise that there are "certain unalienable rights, among these life, liberty and the pursuit of happiness..."

So the Constitution is based on the fact that there are God-given rights that man's law cannot impeded upon. Generally, I guess guns would fall under the "pursuit of happiness" category and possibility "liberty" .... but to say, as Chuck said that gun ownership is a God-given right ... esp. when one of the main purposes of a gun is to inflict harm on another human being .... flying in the face of Christianity ... is a bit of a stretch. ;)

9. 9th Amendment to the Constitution of the United States

"The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people."

This directly and exactly contradicts the concept that we have no rights except those stated in the Constitution. Madison's initial objection to inclusion of a Bill of Rights ... yes, he ultimately was the guy to submit them, but initially opposed the idea altogether ... was that people would claim exactly what you just did.

Rightists often use that same argument against progressive "activism".

And I'm pretty sure that being called gods would not have appealed to even the most egomaniacal of them.
