14 states may target birthright citizenship (14th amendment)
Arizona state politicians will introduce model legislation this week to encourage states to prevent children of illegal immigrants from being granted citizenship under the 14th Amendment.

Lawmakers in at least 14 states have said they are committed to passing the legislation targeting birthright citizenship...The paper says lawmakers in Alabama, Arizona, Delaware, Idaho, Indiana, Michigan, Mississippi, Montana, Nebraska, New Hampshire, Oklahoma, Pennsylvania, Texas and Utah have said they want to introduce similar legislation this year...

The amendment states: "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

The Supreme Court's job is to determine whether laws are constitutional, not whether the Constitution is constitutional.

17. The SCOTUS won't overturn the 14th
But they can define how it is to be applied. My guess is that the states doing this want a determination from the present makeup of the SCOTUS that only Congress has the power under that Amendment to define citizenship. Thus, the issue becomes ripe for asking Congress to get rid of birthright citizenship for the children of illegal immigrants.

5. how exactly is that going to work?
So undocumented people come here, and at some point have a child. What happens then? Send the family back from whence they came? What if Mexico (just using Mexico because it is easy) won't take the infant/child/teenager as their own? That child is then a person without a country. How is that going to work out?

Why is that statement even in the amendment, what is it supposed to mean? This is what I've heard the anti-14thers hang their arguments on. It would have been so much cleaner if it had just said...

"All persons born or naturalized in the United States are citizens of the United States and of the State wherein they reside."

No questions, no interpretation needed.

That clause is what they're attempting to hinge their end-run around the Constitution on. I doubt that even the conservative Court will buy that because it raises a lot of thorny citizenship issues.

Your version of the amendment woud have been much cleaner and clearer. :thumbsup:

former slaves are citizens of the state in which they reside as that was the point of the clause.

The 13th Amedment freed the slaves.

The 14th Amendment made former slaves citizens, repudiated Confederate war debt and kept former Confederate officeholders from holding office in the USA.

The 15th Amendment made former male slaves able to vote.

It was a very badly written amendment which has been used for everything from illegal immigration and abortion rights.
