NM Supreme Court upholds police search of man's underpants

SANTA FE - A police officer was justified in making a roadside search of a man's underpants after a traffic stop, the New Mexico Supreme Court has ruled. Inn a 5-0 decision made public today, the justices reversed a ruling by the state Court of Appeals.

The case involved an unidentified police officer and a motorist named Terry Williams, pulled over for a traffic infraction in Albuquerque. The policeman ran a background check and found that Williams was wanted on a felony warrant. More important, the Supreme Court said, the officer said he noticed that Williams' hands were removed from the steering wheel and he was "fumbling around," as though to conceal a weapon or drugs.
