"Opened in 2009, the mine has been issued 232 orders and citations for safety violations by MSHA inspectors. More than half of the citations were categorized as “significant and substantial,” which means hazards found likely would have resulted in serious injury or illness."

7. You can bet it's not.
If MSHA issued 232 orders and citations for safety violations since 2009 why didn't they close the place? With or without the benefit of a union MSHA is not doing its job.
