Aren't bills in the House supposed to be available for 3 days before a vote?
 
It shall not be in order to consider a bill or joint resolution which has not been reported by a committee until the third calendar day (excluding Saturdays, Sundays, or legal holidays except when the House is in session on such a day) on which such measure has been available to Members, Delegates, and the Resident Commissioner.

can waive or suspend them when they wish.

4. So I guess the question becomes will they remember to waive this rule?

If they don't and the vote proceeds when it is technically out of order, what is the legality of the vote?

5. Oh, trust me - they'll remember.
The rules of order are in constant use in the House. They have a parliamentarian to make sure of that. Watch the proceedings today front to back. You'll see a number of references to the rules. It's a terribly boring thing to watch, but it's interesting to do once in a while. I can only stand it for an hour or two. I've chaired too many meetings to be able to enjoy parliamentary process much any more.
