Eat more kale! (and less Chick-Fil-A)

A folk artist expanding his home business built around the words "eat more kale" says he's ready to fight root-to-feather to protect his phrase from what he sees as an assault by Chick-fil-A, which holds the trademark to the phrase "eat mor chikin."

Bo Muller-Moore uses a hand silkscreen machine to apply his phrase, which he calls an expression of the benefits of local agriculture, on T-shirts and sweatshirts. But his effort to protect his business from copycats drew the attention of Chick-fil-A, the Atlanta-based fast-food chain that uses ads with images of cows that can't spell displaying their own phrase on message boards.

In a letter, a lawyer for Chick-fil-A said Muller-Moore's effort to expand the use of his "eat more kale" message "is likely to cause confusion of the public and dilutes the distinctiveness of Chick-fil-A's intellectual property and diminishes its value."

Chick-fil-A, which trails only Louisville, Ky.-based KFC in market share in the chicken restaurant chain industry, has a long history of guarding its trademark, and the letter listed 30 examples of attempts by others to co-opt the use of the "eat more" phrase that were withdrawn after Chick-fil-A protested. The Oct. 4 letter ordered Muller-Moore to stop using the phrase and turn over his website, eatmorekale.com, to Chick-fil-A.


As if you needed another reason to hate Chick-Fil-A, besides their being fundie nutjobs who won't even open on Sunday. :eyes:

1. Unless he's spellin' it "Mor K-le!" I think he is on solid ground.
I hope someone helps him push back against this nonsense. They don't own the words 'eat' or 'MORE'-- they might have a claim to "mor" accompanied by 'eat,' but that's about it. If you can spell, they have no room.

I ate at a Chick-Fil-A for the first time in my long life a month or two ago; I have to say it was disgustingly delicious. Some of the best fast food I have ever eaten.

3. I agree with you on the "disgusting" part; I ate there one a couple of years ago
it was so greasy that I felt slightly ill afterwards. The prices are sky high too.

7. They did a good job on our meals.
We ate at the politically incorrect Dwarf House, http://www.cfarestaurant.com/hapevilledwarfhouse/home which (I guess) is a landmark. The food was top shelf, to include a massive menu of soul food sides, and the prices were reasonable. Staff was polite and helpful, the manager was pleasant and welcoming. Much as I'd like to be able to criticize, I wouldn't be honest if I said the place sucked because it didn't. The staff could not have been nicer.

It was an "experience the local flavor" expedition, which is why we ended up there in the first place. The only place they have those things up my way is in a couple of food courts in malls. I don't know if the food quality travels well and I probably won't go out of my way to find out, as I am not a mall patron as a rule.

If you're only going to try it once, go to that Dwarf House location.

9. They are being proprietary dickheads--as many people with a "brand" are.
There's a point, though, where you have to say "Cut the shit." In this case, I think that point is reached! They don't own the phrase "Eat more..." -- they could lay claim to Eat "MOR" though--because that's the way their cow mascot spells it.

You'll have to slide over to NH to get some of their product...but never on Sunday!

5. Here's what you do
(1) Call in and ask if they cater
(2) Tell them you are expecting about 200 people
(3) Tell them you are willing to pay extra if they deliver
(4) Tell them you need it delivered at noon on Sunday.

4. reminds me of the Susan G. Komen breast cancer charity
They have sued other charities for using the phrase "for the cure". They've gone after a charities called "Par for the Cure," "Surfing for a Cure," "Cupcakes for a Cure," "Kites for the Cure" and "Mush for the Cure". Something that started out with the best of intentions has become a bully.
