This is a follow-up to a previous thread, Marshall seeks to ban gays from Virginia National Guard.

Virginia Lawmaker: Feds Can't Stop Us From Banning Gays From National Guard

Back in December, wingnut Virginia legislator Bob Marshall announced a bill to ban homosexuals from serving in that state's National Guard. Today we get the text of that bill, which lists numerous examples of gays being booted from the military after declaring that the federal government has no right to tell Virginia who can serve in its National Guard.


I guess Cuccinelli will provide an opinion regarding the legality of this bill. It contains quite a few mistakes.

2. Sadly he may be technically right.
The National Guard operates under State authority except when called to federal orders (Title 10).

Still I doubt this bill will pass
a) because it is stupid. National Guard works w/ regular army and VA soldiers will still get "infected w/ gayness" from being around homosexual soldiers in the regular army and other State units.
b) because I doubt even most Republicans care.

My bet is the bill dies a quiet death in committee.

3. Yes, but doesn't the fed finance the guard? Virginia will just have to
finance their own military.

4. Federal law supercedes state law, sorry guys.
This nullification crap didn't work in 1832 when South Carolina tried it and it's not gonna work now.
