3. Certainly indicates he's a lowlife but I thought if you conspired to do it -
especially if you were a high government official - that was enough to condemn him.

10. Conspiracy involves an agreement to commit an act, PLUS

...an action in furtherance of the conspiracy.

You and I can sit around and plan a bank robbery.

That's fine.

When we agree "okay, let's rob the bank", that's still fine.

When one of us goes out and buys the getaway car - that's not fine.

Forget about Mika's ass , the media is already making it seem like this is the crux of the story.So far, reading the transcripts,he's committed 2 crimes right on tape!

6. Right now I'm more concerned about the media making this
about Mika's ass. If he clearly broke the law,I don't think it would take more than a lawsuit filed by concerned citizens to get the legal ball rolling.

7. To me this seems like a big story but watch the MSM turn it on it's ear.
We'll all be treated to endless discussions about "illegal wiretapping" on the governor and no coverage of the actual contents of the call.

Maybe I will. Maybe I won't.

But talking about thinking about doing something illegal is not illegal.

Conspiring to do it - i.e. reaching an agreement with another person to do it, and then engaging in an act for the purpose of furthering the agreement - that would be illegal.

But in general, talking about a crime or planning a crime without taking any other action in the direction of a crime, tends not to be a crime.

(the exceptions are things where the talking about it is a crime, such as making a threat of violence to someone (and this is not that either - the threat has to be communicated to the person threatened))

You are just quoting more words from a discussion.

Conspiracy = agreement + act

The act has to be in furtherance of the agreement. Something like "he continued to breathe" is not such an act, neither is a further agreement.

That was among the fatal flaw in several counts of the Blagojevich indictment. Just kicking around ideas in a conversation doesn't make the cut.
